Two Insider Trading Cases Become Focus

Two civil enforcement cases filed by the Securities and Exchange Commission may define when insider trading can be rightly called securities fraud, according to a New York Criminal Lawyer.
Actions of civil enforcement have been taken against the billionaire owner of the Dallas Mavericks basketball team, and the former chief executive of Countrywide Financial. These cases are very important to the S.E.C. which is trying to restore its image as the defender of securities markets.

Lower Alcohol Limit Causes Controversy

A police chief in Texas is taking a harder line on DWI, sources tell a New York Criminal Lawyer.
The police chief’s proposal would lower the blood alcohol limit from 0.08 to between 0.05 and 0.07, which means it would be a great deal easier to get arrested for DWI. The charge would not be as great, but bars, of course, still think it’s a fairly terrible idea.
“Pretty soon, you won’t be able to get wine in church,” a bartender told a New York Criminal Lawyer. “You won’t be able to have communion anymore. Even Jesus won’t be able to drink wine.”

Prominent Financial Advisor Stole from Investors

An Omaha financial advisor who had a number of famous clients, including members of the sports world, defrauded investors of over $3 million over a period of four years, a U.S. Attorney related to a New York Criminal Lawyer. The 46-year-old financial advisor pleaded guilty to securities fraud in U.S. District Court.

Couple Swallows Glass, Tries to Collect Insurance

A Massachusetts woman confessed the insurance claims she filed on her own behalf and her husband’s were actually false – their injuries were self-inflicted, a New York Criminal Lawyer has learned. They had eaten glass particles, purposefully, as a part of their scam.
The woman pleaded guilty to a 23-count indictment charging her with fraud and conspiracy, among other offenses, sources told a New York Criminal Lawyer.
Allegedly, the couple had collected more than $200,000 in compensation by filing insurance claims against hotels, restaurants, and grocery stores, claiming the food they had eaten or bought from these places contained glass particles. This all occurred in a period between 1997 and 2005.
The woman’s husband pleaded guilty back in 2007 and has already been sentenced to more than five years in prison. The woman herself will be sentenced in December. Texting a Focus in Arrests of Protesters

Demonstrations have changed with the advent of text messages and social networking and law enforcement has changed to match it, a New York Criminal Lawyer reports. FBI agents raided a house in Jackson Heights, Queens, and searched it for 16 hours. New York Criminal Lawyers believe the reason for the search was suspicion that the man who lived there had helped to coordinate protesters at the Group of 20 summit in Pittsburgh.
The owner of the house, a 41-year-old social worker who was also a self-described anarchist, had already been arrested in Pittsburgh and charged with hindering apprehension or prosecution, criminal use of a communication facility and possession of instruments of crime. Pennsylvania State Police told a Bronx Criminal Lawyer that the social worker was found in a hotel room with computers and police scanners. He was using social networking sites to tell protesters where the police would be. The social worker has denied he did anything wrong.
The criminal complaint in Pennsylvania accuses him of “directing others, specifically protesters of the G-20 summit, in order to avoid apprehension after a lawful order to disperse.”
“He and a friend were part of a communications network among people protesting the G-20,” the social worker’s attorney told a New York Criminal Lawyer. “There’s absolutely nothing that he’s done that should subject him to any criminal liability.”

Con Juan Scammer faces jail, says a Bronx Criminal Lawyer

A con man, who was seen as a notorious Con Juan, used an online dating
site to scam lonely women out of their life savings. He will now be paying
a high price for his loveless actions including a lengthy prison sentence. He facing a variety of charges includign Grand Larceny
A source reports that Con Juan used the online dating
service called My-Space and Jdate to meet women looking for love. He
described himself as a muscular romantic gentleman and lured women into
trusting him with personal information. He continued his scam for years before
his illegal actions placed him in a court of law. It is not known how much money
the con man collected over the years before his scam was discovered.

The scammer met a 60-year-old lonely Chelsea woman who finally ended
his scam. He managed to scam the older lady out of $200,000 before he was
arrested for his illegal activity. A different case of his swindling $10,000 from
a woman he met online has been sealed so the legal result of this case is not
known to Bronx Criminal Lawyers. He allegedly dated the Upper East Sider
for few years before he obtained her ID and then stole money from her bank
account according to police records.

The online scam has come to an end for now with a jail sentence. Manhattan

the crime that much worse. He then sentenced Con Juan to a two and a half

Innocent Teenager Killed in Drive-By

An East Harlem teenager, well-loved by her community, was the innocent victim of a murderous drive-by shooting, early on October 3rd, 2010, sources tell New York Criminal Lawyers. She was simply sitting with friends in the courtyard of her mother’s apartment building.
The 17-year-old girl collapsed on the street, trailing blood from the playground where she was shot. The teenager, who was a student at the Urban Assembly School for Business for Young Women, was pronounced dead 25 minutes later at Harlem Hospital.
“She told the friend she was with, ‘I’m cold. I think I was shot,’”, a neighbor said to a New York Criminal Lawyer. These were her last words.

Four Queens Men Arrested for Boat Burglary

Four Queens men have been arrested by Nassau County police, sources told New York Criminal Lawyers. They were arrested for burglarizing boats in a Manorhaven marina at 2:40 a.m. in late September.
Detectives told a New York Criminal Lawyer that defendants rowed a dinghy from Town Dock to a marina on Matinecock Avenue. They allegedly broke into five separate boats, taking property that included liquor, a laptop computer, and a videogame system.
A boat owner happened to see one of the defendants and informed the police, authorities told a New York City Criminal Lawyer. The four suspects were arrested when they returned to Town Dock with their dinghy. Police were able to recover some of the stolen objects.

Braylon Edwards Arrested for DUI

Braylon Edwards, wide receiver for the New York Jets, was arrested in New York at 5:15 a.m. on September 21, 2010 for driving under the influence, according to a New York Criminal Lawyer.

Japan Turns Away Paris Hilton for Drug Conviction

Paris Hilton is apparently not welcome in the Land of the Rising Sun. She was turned away when she attempted to visit Japan because of her recent conviction for cocaine possession and had to fly back to the United States, New York Criminal Lawyers have learned.

Teen Driver Kills 13-Year-Old Girl in Crash

A 16-year-old boy drove a car down a residential Brooklyn street, traveling more than 60 mph. He lost control and swerved into a parked car, a tree, and a house. A 13-year-old girl in the back seat was killed, police told a New York Criminal Lawyer.
The driver and his friend, also a 16-year-old boy, were not seriously injured in the crash on East 23rd Street at Avenue P in Midwood. The driver was given a Breathalyzer test and passed it.

Police Arrest Members of Pagan Motorcycle Gang

Some leaders of a notorious pagan motorcycle gang were arrested, even as they were allegedly plotting to kill their rivals, according to a New York Criminal Lawyers. Federal authorities raided the gang’s headquarters, a Rocky Point tattoo parlor, to make the arrests.
In the end, 19 suspects were charged, some of them appearing in federal court in Central Islip.
Some of the arrests took place in the Rocky Point tattoo parlor that served as the club’s headquarters on Long Island, and included the man who was once president of the Long Island chapter. He now oversees chapters on Long Island, Sullivan County, New Jersey, and eastern Pennsylvania. His successor as president of the Long Island chapter was also arrested.

These arrests were part of a four-state operation which included not only state and local police, but 300 ATF agents. Times Square Bomber Gets Life in Prison

The would-be bomber of Times Square, Faisal Shahzad, received a life sentence in prison for trying to detonate a car full of explosives, according to a New York Criminal Lawyer.
Shahzad’s comment to his sentencing was “Allahu Akbar” – Arabic for “God is great”. “Brace yourself because the war with the Muslims has only just begun,” he said to the judge right before sentencing. “The defeat of the US is imminent and will happen in the near future.”

Connecticut Man Found Guilty of Murders

All that’s left is the sentencing – which could be the death penalty.
A man convicted of breaking into a home has been convicted of capital murder in a case involving the horrific killings of a Connecticut nurse and her two daughters, sources tell New York Criminal Lawyers. The conviction was difficult for family members, including the father who survived the attacks, but now they must suffer another trial, in which a jury must decide whether the murderer should be put to death.
The 47-year-old crack addict and career burglar raped and strangled the nurse after binding her wrists and ankles in her living room. He also helped his 29-year-old accomplice murder the daughters, ages 17 and 11 by tying them to their beds, dousing them with gasoline and burning them alive. Both died of smoke inhalation, sources told a New York Criminal Lawyer.
The younger girl had been raped by the 29-year-old assailant, according to DNA evidence, while the older girl collapsed on the landing outside her bedroom, still aflame, after her restraints had burned through.

Rutgers Student Complained of Voyeurs Before Fall from Bridge

The Rutgers freshman who jumped off a bridge apparently due to video voyeurism had faced the problem previously, New York Criminal Lawyers have learned. He had already complained to a dorm advisor and two other officials that his roommate spied upon his gay tryst and streamed it live with a webcam.
The deceased 18-year-old student wrote about his difficulties with his roommate on a gay message board. He had tried multiple times to have some action taken because of the voyeurism. There was no hint of suicide in his posts, but he was clearly upset and no longer wished stay with his roommate.
The 18-year-old young man said in the messages that he went to the dorm adviser to get a new room once he learned about the first streaming incident. Ex-Con Charged in Stabbing over Dog

A Brooklyn bartender died in a stabbing when he confronted an ex-con over a fight between their dogs, police sources told a New York Criminal Lawyer. The fight between the dogs occurred outside a country-and-Western bar on Vanderbuilt Ave. in Prospect Heights.
The victim had his miniature black-and-brown pinscher tied to a fence near a salt-and-pepper poodle. The poodle was owned by a 36-year-old patron of the bar, an ex-convict. The leashes of the dogs twisted together and the dogs began to fight. The ex-con, who had already served seven years in prison for manslaughter, came out with his wife to check on the dog. The 41-year-old bartender also came out to see what was happening.

The alleged attacker was treated at Woodhull Hospital for wounds to his hand. Jets Wide Receiver Braylon Edwards Arrested for DUI

Jets wide receiver Braylon Edwards was caught driving under the influence when he was pulled over by police on the Westside. He had double the legal limit of alcohol in his system, authorities told a New York Criminal Lawyer.

Witness Barred in Terror Trial

A federal judge barred prosecutors on Wednesday from using a witness in the first trial of a former detainee of Guantanamo Bay, sources told a New York Criminal Lawyer. The decision has sparked further debate in the issue over whether terrorist detainees should be prosecuted in civilian court.
The trial of the alleged terrorist, charged with participating in the 1998 bombings of United States Embassies in East Africa, is seen by many as a test the Obama Administration’s determination to move other detainees to federal court and shut down Guantanamo.
The judge in charge of the case, from the United States District Court in Manhattan, has denied requests from the defense to dismiss the case because the defendant’s right to a speedy trial has been violated and due to accusations of torture.

SEC Blasted about Goldman Sachs

The Securities and Exchange Commission’s internal watchdog has stated that the timing of a fraud lawsuit against Goldman Sachs was “suspicious”. The statement seems to imply SEC agents attempted to distract attention from a report criticizing the SEC for failing to detect an alleged Ponzi scheme, according to New York Criminal Lawyers.
Lawmakers have asked the SEC Inspector General to look into the filing of the SEC suit against Goldman, who settled the case for $550 million. That same day, the SEC released a report from the Inspector General that concluded the agency had missed a number of chances to catch the perpetrator of an alleged $7 billion fraud, sources told a New York Criminal Lawyer.
The Inspector General was questioned at a Senate Banking Committee hearing regarding the timing of the Goldman suit. “It would strain credulity to think it was coincidental.” He also said: “I can’t give you a conclusion right now, but it was suspicious.”

Manslaughter Conviction Overturned, Due to iPhone

The defendant had already been convicted of manslaughter for killing his neighbor by the jury, according to a New York Criminal Lawyer.
One of the key concepts in the case, included prominently in the jury instructions, was “prudence”. Specifically, they were asked to determine whether the defendant acted in prudence when it came to the victim.
The jury foreperson used his iPhone to access an Encarta and look up the word “prudence”, during a break from deliberations. He then shared this information with the other jurors, sources told New York Criminal Lawyers.
Once the defendant learned of this, he filed a motion seeking a new trial and was denied. Then, he tried to get review from the Court of Appeal of Florida. The appeal court reversed the decision, declaring the defendant was entitled to a retrial.
According to the appellate court, the concept of “prudence” may have been the subject that turned the case one way or another. Using the phone was just the same as using a dictionary and dictionaries are disallowed in juror deliberations. Their statement read in part that they could “not say there [was] no reasonable possibility that the … misconduct … did not affect the verdict in this case.”

Family of Victim Sues Over Hunting Death

The family of a man who died in a tragic hunting accident in Keene in 2008 is now seeking civil action against the man who killed him, New York Criminal Lawyers have learned.
The widow of the victim and her two daughters are plaintiffs in the suit against the shooter, suing him for wrongful death and negligence, as well as other grounds. The complaint, according to New York Criminal Lawyers, lists all the various ways the shooter showed his negligence when he fired that fatal shot.
He has already been convicted of criminally negligent homicide, several months before the suit was filed, and sentenced to the maximum time in prison – one-and-a-third to four years in prison, in September 2010.
The shooter, his victim, and two other men were hunting deer in the woods near Lacey Road in Keene on November 15, 2008, all of them wearing camouflage gear. During the second deer drive, when the victim was one of the drivers and the shooter was one of the watchers, the victim was mistakenly shot. The shooter was put on trial and convicted of negligent homicide in May of 2010.

Drunken Gunman Barely Wounded After Barrage of Bullets

A corrections officer who was brandishing a gun, seems to lead a charmed life. Cops shot at him 20 times and he was only shot in the arm once, sources told a New York Criminal Lawyer. The 35-year-old guard was shot at about 3:45 a.m. in the Bronx after he defied requests to drop his 9mm Glock. Instead, he pointed at the plainclothes officers, sources told a New York Criminal Lawyer.
“There were lots of shots. It sounded like 50,” said a 55-year-old witness. She ducked into an alley with her Yorkie when the guns started to go off.
“The smell of the gunpowder was really heavy,” she told a New York Criminal Lawyer. Witnesses reported a man with a gun was leaving a club and walking down the street, according to a New York Criminal Lawyer.
The guard left the club in anger after a confrontation with a patron’s girlfriend. Four of the five officers who confronted the guard shot at him. The police do not consider 20 shots excessive.
The plainclothes officers, which included two sergeants and three officers from Bronx anti-crime units, wore their badges around their necks and properly identified themselves. They warned the guard to drop his weapon several time before firing, according to both police and witnesses.
Video surveillance shows the guard walking down the street with the loaded Glock, a personal weapon of his. The tape also showed the guard turning his weapon on the officers, who hid behind a van for about 30 seconds before firing. The guard has been charged with menacing and reckless endangerment, and suspended without pay.
