Tennessee Implements DUI Interlock Device as Mandatory for First Time Offenders

It used to be that first time offenders would be let off the hook, or at least given some amount of lenience for drinking and driving. But Tennessee law enforcement realizes that letting first time offenders off with a warning seems to only encourage second time offenders, remarks a New York Criminal Lawyer. Now, getting pulled over and charged with a DWI is going to make your life a lot more difficult, even if it is your first offense. 

Going into effect is the mandatory DUI Interlock Device, and yes, the very first time you get caught, according to the New York Criminal Lawyer. The Interlock Device is a gadget that hooks up to your steering column. In order to start your vehicle you are first required to blow into the device and prove that you are not driving with an elevated blood alcohol content. 

No one wants the inconvenience of having to blow into a machine in order to go anywhere in your car, said the NY Criminal Lawyer, and the social implications of having to do so prohibit people from ever wanting to have that device locked onto their vehicle. It is the hope that this new mandatory procedure will be more of a deterrent than anything else. The intention is to keep people from driving drunk in the first place. 

Evidence suggests that the DUI Interlock Devices have been very successful in deterring drunk driving, according to the N York Criminal Lawyer. It remains to be seen how many of these new devices the Tennessee Police Department is going to be using in the upcoming year.

Man Arrested for DUI Refuses Tests

A 28 year old man was arrested in Amherst, New York after being pulled over by State Troopers on Interstate 290, according to a New York Criminal Lawyer. Sources say that the man was driving his Red Subaru Imprezna erratically and appeared to be intoxicated. He was clocked by police as speeding at 74 mph. 

Upon investigation of the man, reports the NY Criminal Lawyer, State Troopers also determined that he was driving with a suspended license. The man was given the standard field sobriety tests on the roadside, which determined that he was driving while he was intoxicated. Police arrested the man and took him into custody, where he refused to submit to any other chemical test to verify his level of intoxication. 

The New York City Criminal Lawyer reports that the man was charged with several different offenses, including violating the speed limit, driving while intoxicated, DWI, and aggravated unlicensed operation of a motor vehicle in the 3rd degree. All of these charges aside, it is not known whether or not he would have been charged with additional offenses had he submitted to the chemical sobriety tests that were requested of him. 

The New York Criminal Lawyer went on to say that it is legal to refuse such tests and it is within our legal rights to do so. The man asserted his rights, and though he was still charged with the obvious offenses, no other action could have been taken against him since in that instance. The man is currently scheduled to appear in court on January 19, 2011.

Six People Charged in Dog Fighting Incident

Dog fighting is a cruel and dangerous activity and it is highly illegal. In fact, it is illegal to even attend a dogfight, says a NY Criminal Lawyer. This bloody sport results in needless death and suffering for the animals who are forced to fight, and authorities are very quick to investigate any and all dog fighting claims immediately. Dog fighting is an underground activity that is rarely seen. Even though it is elusive, however, it happens everywhere. 

Six people were recently charged with dog fighting in Maywood after authorities managed to stumble across one while they were coming to serve a search warrant for animal cruelty at a residence. The officers found two pit bulls engaged in brutal fighting and they also found a handful of people who were participating in the dogfight, according to reports by the New York Criminal Lawyer. 

Workers from the Animal Welfare League separated and restrained the dogs and they were subsequently taken into custody where they were to receive veterinary care. One man was charged with dog fighting and five other individuals, including three women and two men, were charged and arrested for attending the dogfight, said the New York Criminal Lawyer. 

Dog fighting is a dangerous activity not only to the animals who are involved, said the NYC Criminal Lawyer, but also for the people who are present. People who attend these events are generally not wholesome, good hearted people. Man Caught Driving With BAC Three Times Higher Then the Legal Limit

Some people will say or do anything to justify themselves, and other people will freely admit their wrongdoings without the slightest hint of remorse, according to a New York Criminal Lawyer. In the case of a 23 year old man in Cape Coral, Florida, it seems that was attempting to both justify and dismiss his actions even though he was obviously completely intoxicated behind the wheel.

He was so intoxicated that he told police that it was his birthday and he had been out celebrating at a local bar with friends. When the police ran the man’s information they discovered that the man’s birthday is actually in September.

Woman Drives Under Influence, Crashes into House

Drinking and driving is a serious offense and it is an infinitely dangerous activity. Teen Drinking and Driving Laws Not Strict Enough

According to a New York Criminal Lawyer, even though our nation seems to be targeting teens in drinking and driving campaigns across the country, the laws seem to be on the side of the teens themselves and often give way to leniency in favor of the teen. Petition Gives First Time Teen Offenders a Second Chance

Teen drinking is an escalating problem in our society, according to a New York Criminal Lawyer. The age that children routinely try alcohol has lowered in recent years. Studies show that teens start experimenting with alcohol as early as 13 in many cases, and this sets them up for a bad habit that can devastate them in the future.

Accused Murderer Wants Video Evidence Dismissed

Grandson Charged With Larceny

Although family is the cornerstone for most of us, the ties that bind do not always mean loyalty and love. In the case of one 40 year old man, his loyalty turned out to be more towards himself than to his elderly 89 year old grandmother. According to a New York Criminal LawyerSteve Bilkis the man is being charged with larceny after having stolen over $100,000 from his grandmother’s trust fund. 

Reports said that as a result of the financial drain caused by the embezzlement, the elderly woman had been forced to move from her home, losing everything and having to relocate to a small, dirty trailer, said the New York Criminal Lawyer. 

Apparently, within two weeks of her grandson being named as the trustee by the probate court, the man began taking large chunks of money out of his grandmother’s account and depositing it into two different accounts that he used for businesses that he owned. She lost her house after her grandson had failed to pay her mortgage as she had entrusted him to do. Snowbound Driver Charged With DUI,

Drinking and driving is never a good idea, and even less of a good idea when it is cold and snowing, according to a New York Criminal Lawyer. A 51 year old Pennsylvania woman is probably inclined to agree after being arrested. It seems that her day went from bad to worse after she had a few too many drinks. 

The New York Criminal Lawyer said that the woman had been drinking when she set out in her car on a cold snowy day. Police reports said that the police found the woman stranded in her vehicle in the snow, pointing in the opposite direction that she was supposed to be going. When they approached her, police said that she was no cooperative and refused to get out of the vehicle upon request.

Man is Charged After Christmas Crash Kills Two,

A New York Criminal Lawyer reported that a South Carolina Man has been formally charged after a Christmas Day automobile accident left two dead and two more injured. The man was driving early Christmas Morning when he lost control of his vehicle, a large SUV, sending it veering into the path of an oncoming vehicle and causing a fatal accident.

Attempted Illegal Entry into US Foiled by Drug Sniffing Dog

A Mexican national was found trying to get across the border by hiding amongst paint buckets and other painting supplies, stowed in the back of a pickup truck. Family faces charges of Illegal Re-Entry to the US

A 43-year old mother of an alleged 14-year-old assassin for a Mexican drug cartel was recently charged with entering the United States illegally, according to New York Criminal Lawyers.

The suspect and her husband were arrested and taken from their apartment of eight years to be federally charged with illegal re-entry after previous deportation according to local police reports.

The mother was originally deported back in 1997 for possession of rock cocaine according to police reports. There is no record of her applying for permission back into the States, New York Criminal Lawyers affirmed. Her husband was also previously deported in May of 2002.

It is not yet known what prompted the arrest, but New York Criminal Lawyers related that the couple was arrested in front of their other elementary school-aged children, who were taken from the couple at the scene.

The 14-year old alleged assassin, who has admitted to participating in at least four beheadings, is being held in a protected location while Mexican Authorities search for evidence of citizenship and other details. The boy was reportedly born in San Diego.

His two older sisters are being held in a Mexico City detention facility for one month while authorities continue to investigate their possible ties to organized crime, New York Criminal Attorneys explained.

In a related story, three suspects were arrested this week for possibly working for the same drug gang located in the central Mexican city of Cuernavaca. Arresting army troops were led to an area where suspects allegedly buried at least two of their homicide victims.

Unusual Drinking While Not Driving Case Makes Headlines

Just when you thought you had heard it all, along comes a case with an unusual twist recounted a New York Criminal Lawyer. In this case, a man was found drunk and in the driver’s seat, but, had not been driving.
The man, who had been arrested, had always stuck to his story that he was not drinking and driving and in fact, when he slid off an icy road on the way home, he was stone cold sober. He texted his girlfriend and told her he had crashed, grabbed a bottle of brandy he along with him in the car and drank it to stay warm. He figured it would be a good thing to do while he was waiting for help to get out of his predicament.
Two hours after he had crashed, rescue crews arrived and found him unresponsive. When they tested his blood alcohol content, it was 0.148. Good thing too, otherwise he would have spent a year in the clink and been hit with a fine of $1,000.

Governor Paterson Pardons Six Immigrants at Risk for Deportation

After a clemency process aimed at assisting green card holders at risk of deportation because of past criminal convictions, and a meeting with his pardon panel, Governor David A. Paterson pardoned six out of 1,100 immigrants Monday including a financial administrator from the City University of New York, a New York Criminal Lawyer related.

“Federal immigration laws,” Paterson said, “are often inflexible, arbitrarily applied and excessively harsh, resulting in the deportation of individuals who have paid the price for their crimes and are now making positive contributions to our society. These pardons represent an attempt to achieve fairness and justice.”

New York Criminal Lawyers predict the governor will issue another batch of pardons before his term ends this month.

Dominican immigrant, Mario Benitez, 58, who pleaded guilty to selling controlled substances and served three years in prison, is the administrator who was pardoned. He is the current assistant director of finance for CUNY’s Graduate School and University Center. The panel praised Mr. Benitez’s accomplishments since his release from prison, most notably his rise “to jobs with higher levels of responsibility” as well as his mentoring and community involvement in the Bronx.

Two other notable pardons went to 32-year old Kevin Auyeung, who was convicted of robbery at age 17 and 41-year-old Deborah Salako-Nation who faced larceny and forgery convictions. Both immigrants have shown substantial improvement and are productive members of society, explained a New York Criminal Lawyer.

25-year old Darshini Ramsaran, who was born in Guyana and Trinidad, faced deportation for robbery. Paterson felt deporting Ramsaran would put her life in danger.

Grief-stricken Father loses his license after driving drunk and harassing 16-year-old

The stress of his son’s death may have caused a grieving father to go too far in a recent traffic incident, established New York Criminal Lawyers.

The distressed father, whose son was killed on his motorcycle last spring by a driver accused of running a red light, has temporarily lost his license after being charged with driving drunk, New York Criminal Lawyers explained.

After a field sobriety test and finally a blood test, the man’s blood alcohol level tested well beyond the legal limit, according to police reports.

The man was allegedly tailgating and harassing a 16-year-old girl, who filed a complaint at the police station shortly after the incident. After being arrested, the man claimed the 16-year-old girl ran the same red light as the driver, who killed his son, which led to his abnormal behavior.

The man’s license was suspended after he was charged with DUI and other offenses, according to New York City Criminal Lawyers. The grieving father did not enter a plea. Additional details are not available until further investigation is complete.

The driver, who killed the man’s son, had multiple repeat traffic violations before he was charged with running the red light. The unnecessary death led to a new state law cracking down on drivers with multiple traffic offenses.

Repeat offenders are given stronger sentences and heavier fines according to court records and traffic violations have gone down slightly since then.

The grieving father was not available for comment when reporters called his home for answers.

Council Candidate Drives Drunk the night before he would have been sworn in

Felipe Hueso, San Diego City Council candidate spent the night in jail for allegedly driving drunk Monday night. Tests confirmed Hueso had a blood-alcohol level of .15, which is nearly double the legal limit of .08, New York Criminal Atorneys reported.

Before Hueso was pulled over, the arresting officer noticed he was driving his Jeep Wrangler with the outside off-road spotlights on. Legally the off-road lamps should be turned off when a vehicle drives down public and residential streets, according to New York Criminal Lawyers.

Minutes later the officer stopped the Wrangler and identified the driver as Felipe Hueso. Upon further investigation the officer suspected Hueso had been drinking and conducted a field sobriety test and followed it up downtown at the police headquarters with a Breathalyzer. The final test revealed the .15 percent blood-alcohol level, said New York Criminal Lawyers.

Hueso was booked and arrested for suspicion of driving under the influence. Officers were unavailable for comment but all signs indicate Hueso was released on bail the next morning.

Hueso, after a long campaign, lost the District 8 race to David Alvarez on Nov. 2 of last year. Hueso’s goal was to replace his brother, Ben, on the council. He was arrested for drinking and driving on the very same day he would have been sworn-in had he won the position on the council. Ben Hueso was successfully sworn into the Assembly on Monday and reportedly celebrated with his family.

Drunken Driver strikes again after serving prison term

A 32-year-old man was arrested this weekend for committing nearly the same crime in 1999 that left him imprisoned and without a driver’s license for several years. The suspect killed a 10-year-old girl in a crash more than a decade ago after driving drunk and was arrested this past weekend for driving while intoxicated again, New York Criminal Lawyers report.

“He hasn't learned anything in all these years," said a grieving 49-year old man, whose daughter was killed in the 1999 accident. According to police reports the man crashed into the family’s car in 1999 and only the 10-year-old girl was killed.

The suspect allegedly crashed onto the lawn of a local resident this past weekend and was found slumped over the steering wheel with the car still running and a half of a bottle of vodka sitting near him. He sustained only minor injuries at the scene according to police and required no hospitalization.

Neighbors alerted the police as soon as they saw the car on the lawn, according to NY Criminal Lawyers. Police immediately brought the suspect into custody where he was charged with driving while intoxicated once again. There were no family members available for comment about the history of the suspect in these cases.

The man was held on $50,000 for bail and spent several days in jail according to local authorities. Police were unavailable for comment, states New York Criminal Lawyers, but according to reports, it is likely the suspect will serve another prison term.

Ex-Yankee takes no responsibility to this day for drinking and driving, report New York Criminal Lawyers.

Jim Leyritz still blames his victim for his own drinking and driving incident and hasn’t learned a thing, said New York Criminal Lawyers.

"My life was dragged though the mud because I was a Yankee. I got tried because I'm an athlete! There was a good chance I was innocent!" Said ex-New York Yankee Jim Leyritz, 46, who drove drunk, killed a woman and never went to jail.

Leyritz, who was extremely angry at the police who arrested him threatened, "I'm gonna make them lose their jobs." He went on to slander his victim -- a waitress and mother who was killed on her way home in Florida at 3 a.m.
"I knew the girl," he revealed to New York Criminal Lawyers. "She was a dancer at one of the nightclubs."

When asked if the girl was a stripper, he said laughing, "I don't like to use the word," "She's a party girl."

New York Criminal Lawyers alleged that Leyritz ran a red light after consuming 11 to 12 shots of alcohol. Nobody could prove the light was red, and Leyritz refused a Breathalyzer test at the scene of the crash but tested a .14 three hours later, which is way over the .08 legal driving limit.

Leyritz was ultimately convicted by a jury of misdemeanor driving under the influence, reduced from the original charge of manslaughter, according to New York Criminal Lawyers. His sentence was probation.

"It was an accident. A onetime accident," he has said. "It could happen to you! You could lose three years of your life. I'm a good person!"

Crime Scene Photographer charged with his fourth DUI, reports New York Criminal Lawyers

A 51-year old man, who was a crash scene photographer, was charged with a DUI this week, after he was seen driving right past the scene of a fatal crash by local police, New York Criminal Lawyers reported.

The suspect has been convicted three times in the past fifteen years for driving while intoxicated according to court documents.

Police suspected the photographer was drunk when he drove past the crash scene, went down the street, then returned and parked half on the street and half on the curb.

Upon further investigation the man failed a field-sobriety test and was taken to a local hospital for blood tests, which revealed he was well over the .08 percent limit for driving.

"He came to our office here, signed out a pool vehicle, drove to the scene of the accident, and it was when he arrived there that state police did their job very well," reported the employer of the suspect.

"If the information is accurate, then the last time this employee was convicted was over a decade ago," adding that the company evaluates employees on a case-by-case basis. "And if they go through the ARD program and successfully complete it, then they are reinstated after all that is completed to our satisfaction, and only then."

Possible Drunk Woman arrested for striking cars and injuring, New York Criminal Lawyers Report

A 62-year-old woman, suspected of driving drunk, crashed her Mercedes-Benz multiple times injuring two people and damaging four vehicles in under ten minutes Tuesday, according to New York Criminal Lawyers.

The suspect’s car finally hit a tree, where an innocent bystander took the keys out of the car and held the driver until officers arrived New York Criminal Lawyers said.
"She tried to get away going eastbound on Santa Cruz," said a Police spokesperson.
"It looked like she was trying to go across the median because she saw a lot of traffic, but was unsuccessful because of the tree."

The accidents began when the driver backed out of her parking spot, and struck two parked cars while simultaneously pinning a man between two cars. While others in the parking lot helped free the trapped man, she flew down another street and hit two parked cars, one with a woman in it, before finally hitting the tree to end her tirade.

"The accidents took place in two different spots, but it didn't take that long," New York Criminal Lawyers report.

The man who was trapped between two cars and the woman who was in one of the parked cars she hit were both left with minor injuries.

The suspect was taken to the police station where she refused a field sobriety test. A Phlebotomist checked her blood was unavailable for comment on the results. She was ultimately arrested for allegedly driving drunk, driving recklessly and hitting two cars and running causing injuries for two people.

Deadbeat Dad allegedly abducts his son and is added to Crime Stoppers top 10, reports New York Criminal Lawyers

A 46-year-old man disappeared with his 11-year-old son on October 10 has just been added to the Crime Stoppers 10 Most Wanted List. New York Criminal Lawyers reported he allegedly abducted the boy two days before what was supposed to be a regular visitation.

According to local authorities, the man might have fled with the boy in a panic because he hadn’t been holding up his agreement in the divorce and he learned there was a warrant out for his arrest.

New York Criminal Lawyers said the boy was seen getting into his Dad’s green 1997 Chevy Tahoe and never showed up for the school the next day.

Police said in the hours and days after the man fled with the boy, he had numerous phone conversations with the boy's mother, threatening to kill both her and her parents if she didn't cooperate by getting the warrants dropped.

The suspect suffers from terminal cancer and authorities suspect he hasn't been taking his pain medication - which would make it very difficult for him to properly care for the boy.

Investigators speculate the suspect traveled to Alabama at some point, but have grown cold on his trail.
