Florida Fireman is arrested for DUI

One of the people responsible for the public safety for citizens in Florida is under arrest. A fireman who works with the Bonita Springs Fire Department was arrested for suspicion of DUI in January. A New York Criminal Lawyer says the man was seen driving erratically on a weeknight, late at night. He was pulled over and administered a sobriety test.
The police man who made the arrest did not comment on the case of the situation, since the police department and the fire department work together often. The Bonita Springs spokeswoman for the district says that the fireman will remain on staff until after his trial. The N York Criminal Lawyer believes that the job of the fireman may be in jeopardy since his job requires the driving ability of the fire trucks and rescue vehicles to get to the scene of many of the accidents. Many other public service agencies have similar rules that make their employees have clean driving records in order to maintain employment.

There is no official word on his upcoming trial or if he will seek a plea to avoid charges of DWI being placed on his record. Georgia Sued for Failure to Provide Legal Counsel

The right to legal counsel is one of the basic rights that are guaranteed by the U.S. Bill of Rights. While there are some who may argue that applies only to criminal cases, an attorney for at least six indigent parents who have been incarcerated in various Georgia jails says otherwise, a New York City Criminal Lawyer discovered.
A senior attorney with the civil rights group the Southern Center for Human Rights (SCHR), has filed a class action lawsuit in Fulton County Superior Court on behalf of at least six parents that are currently sitting in a Georgia jail for being too poor to pay their child support payments. The suit further alleges that the State of Georgia has continued to incarcerate these parents in some cases for more than a year and has failed to provide them with the legal counsel they need to prove that they are indigent.
When contacted by a N York City Criminal Attorney, the Georgia Attorney General’s office had little to say other than they had not seen the complaint, nor have they reviewed any of the circumstances of the plaintiffs. Based on these factors, they had no further comments. However, the attorney who is representing those parents who are affected by this had many comments.
The SCHR attorney also told the New York Criminal Attorney that all of the parents that she represents made attempts to pay child support. One of her clients, she said, is an unemployed military veteran who has been unable to find a job. While another had a history of making his child support payments on time…until hard economic times caused him to be laid off from his employer. Soon after he found a part-time job, within four weeks, he was arrested for being behind on his child support payments and he has been locked away in jail since October 2010. She further added that had this gentleman have had legal counsel, he could have proved that he was indigent. Instead, he was forced to fend for himself and was jailed. He also cannot afford to pay the $250 fine in order to secure his release.
The attorney for the plaintiffs went on to add that “Children are not served when parents who are searching for work to support their families are repeatedly carted off to jail.”

Driving under the influence gets prosecutor arrested after work

DWI is a threat that spans racial and economic boundaries, according to a New York Criminal Lawyer. There is no general description of what type of person is most likely to drive while they are drunk. It can happen to a fry cook as easily as a doctor. The incidences of upstanding members of society being busted for driving while drunk are growing. 

Alcohol abuse can affect anyone, and the case of the prosecutor who was found to be driving drunk just shortly after having been in court all day is a good example of that. The prosecutor did not sign any warrants on that day, and coworkers did not assume the man to be intoxicated. 

After the prosecutor had left his office for the day, he was pulled over when police were alerted to a black Subaru Outback driving erratically across the center line. The police on the scene reported that the driver was obviously intoxicated. The officers said they smelled alcohol and that the driver was disoriented. The prosecutor admitted that he had been drinking. He refused to submit to the field sobriety tests that were requested of him, but officers felt that they were justified in arresting him.

Tennessee Implements DUI Interlock Device as Mandatory for First Time Offenders

It used to be that first time offenders would be let off the hook, or at least given some amount of lenience for drinking and driving. But Tennessee law enforcement realizes that letting first time offenders off with a warning seems to only encourage second time offenders, remarks a New York Criminal Lawyer. Now, getting pulled over and charged with a DWI is going to make your life a lot more difficult, even if it is your first offense. 

Going into effect is the mandatory DUI Interlock Device, and yes, the very first time you get caught, according to the New York Criminal Lawyer. The Interlock Device is a gadget that hooks up to your steering column. In order to start your vehicle you are first required to blow into the device and prove that you are not driving with an elevated blood alcohol content.

Successful Application of DUI Checkpoints Over the Holidays

According to a New York Criminal Lawyer, law enforcement officials executed a well thought out plan to stop drunk drivers in their tracks over the holiday season, keeping the roadways safe for all drivers and passengers. Killing of College Football Star by Cops Angers Many

A Pace University football player was killed by the police outside a Westchester bar – and his friends claim he was only trying to move his illegally parked car, sources told a New York Criminal Lawyer.
The father of a passenger in the football star’s car says the slain student thought he was only being asked to move his car when an officer knocked in the windshield. He was parked in a fire lane.
As the football player began to drive away “an officer jumped out from between cars and started firing, and the next thing [the young men] knew, [one cop] was on the hood,” the passenger’s father told a Staten Island Criminal Lawyer. The student “Yelled several times as they were pulling him out of the vehicle, screaming ‘They shot me! They shot me! They shot me!’”, the passenger’s father continued.
According to police, the officers fired on the car because the driver sped off, hitting two cops, after one of the officers tapped on the window of the vehicle. A Pleasantville officer, formerly of the NYPD, was thrown onto the hood of the football star’s moving car, police say. The cop fired at the driver, who swerved into another officer, who also started shooting.

Photos Revealed of Toddler Duct-Taped by Mother

Nebraska prosecutors have revealed photos of a teenage mother and her boyfriend duct-taping her 2-year-old son to a wall. The pair has already been convicted for the incident, according to New York Criminal Lawyers. They claim to have done it all for fun.
The child was temporarily removed from his mother’s custody, but is now living with his mother again. The mother, 18, has admitted to using drugs.
The mother, 17 at the time of the abuse, was given 10 days in jail and two years of probation. Her 19-year-old boyfriend, an ex-convict, was given a stiffer sentence – three to five years for child abuse and another 12 to 24 months for felony possession of stolen firearms. While under the influence of drugs, the mother held the child down so her boyfriend could tape his body to the wall with bright green duct tape, authorities told a New York Criminal Lawyer.
Some of the pictures show the boy’s wrists tape to the wall behind his back and above his shoulders as he struggles to escape. Another shows the mother posing with her son, whose hands have been wrapped in tape. Yet another photograph shows the boy’s sippy cup taped to a wall out of his reach. The boy has been allowed to return to his mother, but state health officials are keeping track of the home, a county attorney told a New York Criminal Lawyer. Prosecutors are investigating to see if the mother should retain custody.

Cop Acquitted of Assault Charges Against Judge Girlfriend

Though whatever occurred between a police officer and his judge girlfriend resulted in her sustaining a cut on her scalp and multiple scrapes and bruises, it did not amount to assault, according to a Philadelphia Common Pleas Court jury.
It took five hours of deliberations over two days for the jury – composed of eight women and four men – to acquit the 49-year-old officer of both aggravated and simple assault charges, sources told a New York Criminal Lawyer. The officer was found guilty, however, of violating Pennsylvania’s wiretap statute. He recorded a number of the judge’s angry calls to him three days after their fight without her consent or knowledge.
Three days after the altercation, the officer had already been suspended from his job as a narcotics detective. His defense attorney told a New York Criminal Lawyer that the recordings had been an attempt for the officer to defend himself against his bosses, because he feared his side of the story would not have been believed otherwise.
The verdict will likely not result in jail time, but could result on job loss. The officer had no comment as he left the hearing. Man Dies 4 Days After Stabbing

A 27-year-old man was stabbed in the chest in his hometown of Freeport and died four days later, Nassau County police told a New York Criminal Lawyer. The victim had some sort of altercation with two men on Broadway. Police told a New York Criminal Lawyer one assailant punched and kicked the victim, and the second assailant stabbed the victim with a kitchen knife at 9:40 p.m. on Sunday.

Cab Crashes Into Coffee Shop, Injuring Five, Reports New York Criminal Lawyer

A yellow cab smashed into an East Village coffee shop after losing control early one morning, critically injuring an elderly man, and hurting four others, police sources told a New York Criminal Lawyer.
The taxi was headed north on First Ave. when it hit a Jeep Cherokee turning from E. Third street, according to a New York Criminal Lawyer. The taxi left the street and struck two bicyclists, then went into the coffee shop, hitting a 71-year-old man who was sitting at a table by the front window.

Bronx Principal in Trouble for Possible Bid-Rigging

The job of a Bronx principal may be in danger after he was found to be giving a contract to an after-school program for a business he was a part of, officials told a New York Criminal Lawyer.
The principal was relieved of his duties at Community School 50 in the Bronx after a Special Commissioner of Investigations determined that the principal had helped to rig the bids, a New York Criminal Lawyer has learned.

State’s Highest Court Will Not Take Manslaughter Appeal, says a New York Criminal Lawyer

The state’s highest court has refused to hear the appeal of a man convicted of second-degree manslaughter in the fatal shooting of a Selden teenager. The incident occurred outside the convicted man’s home at Miller Place.
The 56-year-old man seems to have no other recourse for appeals and will soon be back in court for sentencing, a spokeswoman for the Suffolk County district attorney’s office told a New York Criminal Lawyer. At that point, the judge could send the man to prison for 2 to 4 years for the death of a seventeen-year-old boy in 2006.
The now convicted man has been free on $200,000 bail during the appeals process. The judge wrote, “There is no question of law presented which ought to be reviewed by the Court of Appeals.” The defendant’s attorney told a New York Criminal Lawyer he was “evaluating our additional options.”

New York policeman being sued for discrimination

A New York Police commander is being sued for sexual discrimination by one of his former assistants, reports a New York Discrimination Lawyer. The commander stands accused of having an affair with his former Compstat assistant and part-time driver. To make matters worse, he has just admitted to having lied under oath. According to a New York Criminal Lawyer, he had previously denied the affair while under oath at a deposition.

After the commander found out that the city’s Law Department would no longer be representing him, his lawyer issued a statement that the accused wished to clarify his prior statement and that he had indeed had an affair with his former underling. The woman he is said to have had an affair with has not been named, as she is not the defendant in the case, but it is rather another officer saying that the commander discriminates against female police officers that he supervises.

The main form of discrimination appears to have come in the benefits bestowed upon his alleged mistress, how is said to have received additional overtime and the ability to make her own schedule. Cinco De Mayo turns into massive brawl

On Cinco De Mayo, a small scuffle at a party turned into a huge fight. According to a New York Criminal Lawyer, the fight started between two women but quickly spread. The night had violence seemingly from start to finish, as a few smaller altercations had occurred earlier, but at about 12:30 a.m. a couple groups of partiers were leaving when the fight started.

To give a sense of scale, the fight eventually involved over 100 people, with many injured before all was said and done. The most serious injury appears to have been a local college student who was stabbed in his left side while arguing with a few people. Most people who experience Driver’s License Suspension are often surprised. Sometimes the first they learn of this problem is when they are arrested.
