A Las Vegas couple charged in the death of their son

In the Las Vegas corridor of Nevada, a husband and wife have been found guilty of a primary charge of involuntary manslaughter of their young son, as well as secondary charged of child abuse and neglect.

According to court documents, the man and woman charged in this case were highly negligent of their son, which resulted in a fatal episode that occurred around 2.5 years ago. In June 2008 following the attendance of a church gathering in the community, the couple returned home with their five children and proceeded into their home. Unfortunately, one of their sons was left in the vehicle. A New York Criminal Lawyer notes that the young boy, who at the time was 4 years old, suffered from muscular dystrophy and lacked the physical strength to open the car door and escape.

Approximately 17 hours later, the trapped young boy was found deceased in the family’s vehicle; the cause of death being heat exposure, apparently. The father and mother were taken into custody on March 01 following the result of the trial, which was conclusive in its evidential circumstances and sentencing. Upon being taken into custody the couple was held at $500,000 bail and $250,000 bail, respectively. Charges of child abuse, domestic violence and neglect were also attributed to the couple, in addition to the primary of charge of involuntary manslaughter, according to a New York City Criminal Lawyer.

The total sentencing for such crimes would conceivably carry a maximum penalty of 50 years in prison for the father and 26 years in prison for the mother. The official proceeding of sentencing is slated to take place on May 31 of this year. It will be at that time that the final penalty will made known to all involved. A NYork Criminal Lawyer realizes that the current state of the other four children belonging to the couple is unknown. What can be said with certainty is that this tragedy had devastated a family and the community in which they dwell. Two parents must live with the grief of their involvement in their son’s death, and four young children must now endure the loss of a brother and the absence of their parents.

Suspect Arrested in Shooting Death

Within hours of the killing, the shooting suspect was in police custody, reports a New York City Criminal Lawyer. While the exact cause of the shooting is still unclear and the investigation is continuing, there are some facts of this case that are clear.
At approximately 11:20pm on Tuesday night, the suspect entered into the home where he had previously been staying with his sister and her boyfriend until moving out recently. After some discussion, the suspect was told to leave by the victim. It was at this point that he pulled out a gun and shot his sister’s boyfriend multiple times in front of her and another unidentified person, and then fled the scene. The shooting suspect’s sister frantically called 911 and was at the location when the police arrived and gave police a description of the suspect’s vehicle. The suspect was soon located driving south and was arrested by officers without incident. The New York Criminal Lawyer has confirmed that the shooting suspect is being held without bail and is facing murder charges.
What police still do not have in this case is a motive for the shooting. The suspect’s sister has stated that he just started shooting for no apparent reason after being asked to leave. Although the victim was the grandson of a late, well-known local defense attorney, and there were more than 1,500 marijuana plants discovered at the scene, none of these seem to be contributing factors to the cause of the shooting, reports a NYC Criminal Lawyer.
On Wednesday, a fire truck reportedly arrived at the scene and within a short time, a flat-bed truck was seen leaving the scene with a confirmed 1,500 marijuana plants that had a brown cloth covering them. Investigators have determined that no one at the scene was in possession of the medical marijuana documentation that is necessary for them to grow the plants.
The inhabitants of the neighborhood are in disbelief as the area of the shooting is quiet and none of the victim’s neighbors have reported any incidents with anyone at that property in the past. One of the local residents simply stated that it was a total shock that something like that could have happened in their community.

Human jawbone washes up on Aruba beach, reopens old mysteries

A grisly discovery was made on an Aruba beach recently. A human jawbone washed up on the sands, opening old wounds to previous disappearances, explained a New York Criminal Lawyer. The remains were found by someone wandering the beach and turned in to local authorities. The jawbone is believed to be that of a white Caucasian female. A single tooth remained in the jawbone, and forensic tests are being used to try and determine the identity of the person.

According to the New York City Criminal Lawyer, R. Fitchetta, the jawbone found is does not belong to a young girl that went missing from a senior class trip in 2005, as was at first suspected. It is interesting to note that fifteen tourists have disappeared while in Aruba vacationing in the last ten years, which is an astonishing number of mysteries that have yet to be solved.

In 1998 a 23 year old woman disappeared off of a cruise ship while it was docking in Aruba, reports the New York Criminal Lawyer. She was last seen heading off down the hall of the cruise ship after saying goodnight to acquaintances while she was vacationing with her parents. The parents of the woman repeatedly claim that they got no real assistance from authorities in Aruba about their missing daughter. Thirteen years later and they are still no closer to finding out what happened to their daughter.

Vacationing in other parts of the world can be risky, insists the N York Criminal Lawyer. Abductions and crimes are more difficult to track and solve when a foreigner is involved. Most vacationers expect that the same laws will apply in other countries as they are accustomed to in theirs, but it is increasingly becoming more clear that in instances like these missing tourists, it simply isn't the case.

Crimes can be committed anywhere and it can happen to anyone.

Snowbound Driver Charged With DUI,

Drinking and driving is never a good idea, and even less of a good idea when it is cold and snowing, according to a New York Criminal Lawyer. A 51 year old Pennsylvania woman is probably inclined to agree after being arrested. It seems that her day went from bad to worse after she had a few too many drinks.

The New York Criminal Lawyer said that the woman had been drinking when she set out in her car on a cold snowy day. Police reports said that the police found the woman stranded in her vehicle in the snow, pointing in the opposite direction that she was supposed to be going. When they approached her, police said that she was no cooperative and refused to get out of the vehicle upon request.

The New York Criminal Attorney stated that the officers reported a distinct smell of alcohol coming from the inside of the vehicle and that it was obvious that she was intoxicated by her manner of speech and body language cues. The woman also refused to take a breathalyzer field sobriety test. At that point she became belligerent to the point where police had reason to restrain her.

With some small degree of force they extracted her from the vehicle and proceeded to arrest her, according to the New York Criminal Lawyer. She was incarcerated after not being able to make bail, which had been set as $2300 and remains in custody. More information will follow pending developments on this case.

Deadbeat Dad allegedly abducts his son and is added to Crime Stoppers top 10, reports New York Criminal Lawyers

A 46-year-old man disappeared with his 11-year-old son on October 10 has just been added to the Crime Stoppers 10 Most Wanted List. New York Criminal Lawyers reported he allegedly abducted the boy two days before what was supposed to be a regular visitation.

According to local authorities, the man might have fled with the boy in a panic because he hadn’t been holding up his agreement in the divorce and he learned there was a warrant out for his arrest.

New York Criminal Lawyers said the boy was seen getting into his Dad’s green 1997 Chevy Tahoe and never showed up for the school the next day.

Police said in the hours and days after the man fled with the boy, he had numerous phone conversations with the boy's mother, threatening to kill both her and her parents if she didn't cooperate by getting the warrants dropped.

The suspect suffers from terminal cancer and authorities suspect he hasn't been taking his pain medication - which would make it very difficult for him to properly care for the boy.

According to New York Criminal Lawyers, the suspect has no known relatives who may be helping him take care of the boy.

Investigators speculate the suspect traveled to Alabama at some point, but have grown cold on his trail. Local police urge civilians to call Crime Stoppers if they believe they’ve seen anyone resembling the suspect and the boy in a Chevy Tahoe. A cash reward has been offered according to New York Criminal Lawyers.

Being charged with a crime or chased by the law takes a toll on you no matter what the crime. Being defended properly can help ease the pain and New York Criminal Attorneys understand the job better than anyone. For the best handling of your case you can trust New York Criminal Attorneys.

Right Wing Internet Radio Host Hal Turner Sentenced to 33 Months in Prison for Threatening Judges,

Harold C. “Hal” Turner, a former FBI informant and current Internet shock jock, has received a 33 month prison sentence because of comments that were made on his ultra right wing Internet blog in early 2009, according to a New York Criminal Lawyer.

Mr. Turner defended his position as a major media figure by stating that his angry blog rant, in which he wrote that three circuit court judges “deserve to be killed” for their ruling in favor of upholding handgun bans in Chicago and Oak Park, Il, was purely protected under the right to free speech and was never intended to cause harm or invoke a sense of danger to those judges, a New York Criminal Lawyer reported.

Turner maintained that, though his comments in regards to his position may have been extreme and even “disgusting” to some individuals, his large and highly opinionated fan base has come to expect and respect his extremist political stance and that he was being erroneously attacked and labeled, according to the New York Criminal Lawyer. Turner also professed his love for the United States of America and used his past history as an FBI informant to strengthen his loyalty to the US, and was said to imply that his opinions and his actions have actually made the country a safer place.

Turner, who was arrested in June 2009, has spent more than eight months in jail, which will be applied to his sentence, after which he will be barred from participating in Internet radio or satellite radio programming for three years , reports said. Turner is filing an appeal against the courts ruling.

The United States justice system can seem threatening and hostile to persons who have been accused of a crime. Finding a New York Criminal Attorney who will take your case and side with you in your defense is key. A reputable New York Criminal Attorney can be your best asset in terms of upholding your legal rights in such a situation.

Rabbis At Heart of Sex Abuse Scandal

A man of the clothe uses his position of power to sexually abuse a helpless victim. His church looks the other way, perhaps out of shame or something more nefarious, and the abuse continues on for years. Victims claim they have been hurt but no one listens because, after all, what holy man would ever do that to an innocent? But the twist in this story is that this time it is not the Catholic Church at the center of everything, but rather the Orthodox Jewish Community, reports a New York Criminal Lawyer.

A manhunt has begun for a rabbit and his twenty something year old son. Both are wanted in connection with the sexual abuse of at least four women - all of them, disgustingly enough, family members. The horrible tale is just the tip of the iceberg, according to a New York Criminal Lawyer. In Brooklyn alone there have been at least twenty nine reported investigations into sexual abuse at the hands of Orthodox Jewish Rabbis. Spokespeople believe this is an unchecked epidemic that may be silently sweeping the nation, says a New York Criminal Lawyer. Much like the sex abuse scandal that has plagued the Catholic Church, the repercussions of this story may only just be beginning.

As for why the abuse is never reported, speculations are rampant but the most common is simple: the belief that even if the behavior is wrong the punishment should be handled within the community, notes a New York Criminal Lawyer. Police one's own people, as the saying might go.

If you find yourself the victim of, the accused of, sexual abuse, contact a New York Criminal Attorney today to ensure you are protected.

Innocent Man Set Free

Every day for nearly sixteen years he sat in a tiny jail cell convinced that he was going to die. He had been charged and convicted of helping murder a family. An innocent family was beaten, bruised, battered, tied down, murdered, and finally set on fire, said a New York Criminal Lawyer. The prosecutors said that the man had helped killed a woman and her four children. Yet, the only evidence linking the man to the murders was the testimony of the man believed to have carried out the actual killings, reports a New York Criminal Lawyer.

That man later recanted his statement, professing that the newly freed man was innocent of all wrong doing. Prosecutors apparently did not care and kept him in jail. In 2006 a judge overturned his conviction, finding that there was not enough evidence. This didn't matter to prosecutors: they retired him, said a New York Criminal Lawyer. They went forward with another trial, another attempt to put this man behind bars, another try and sentencing him to death - and they had no evidence. As such, the man is now free as the charges against him have been dropped, said a New York Criminal Lawyer.

Almost two decades of life not just gone, not just forever lost, but spent convinced that you are going to face death. Face death for a crime you never committed. That is the terrible, horrible, life changing fate he found himself facing and that is the hell he will never forget.

Murder and other capital crimes are serious. Lives are lost and freedoms stolen. If you've been charged with a crime contact a New York Criminal Attorney.

Murder Suspect Held Without Bail

A Brooklyn man has been charged with the murder of a Pace University student and ordered to be held without bail – and even prosecutors agree that the man was not actually the shooter. It was his accomplice that committed the fatal act, sources told a New York Criminal Lawyer.
The 21-year-old victim of the shooting was a dealer of marijuana who lived in a high-rise building on Gold Street in lower Manhattan. He was murdered by gunfire on September 29.
The 30-year-old suspect was in court, facing charges of murder, burglary, and assault, according to New York Criminal Lawyers. His accomplice, also 30, was still in Pennsylvania, as prosecutors attempted to extradite him from the other state back to New York. “When [the victim] put up a fight, the co-defendant shot and killed him,” an assistant district attorney told a New York Criminal Lawyer.
Police sources say the two suspects entered the apartment just after midnight, as two people who had just bought and smoked marijuana were on their way out. Prosecutors told New York Criminal Lawyers that the man being held without bail beat one of the witnesses as he tried to get away. He even threatened the witness’s life.
The suspect’s attorney said his client had nothing to do with either planning or committing the murder itself. Video cameras showed the suspects just moments before the shooting, wearing matching Chicago White Sox caps, New York Criminal Lawyers have learned.
Representation can make all the difference in a trial, which is why you need a New York Criminal Attorney on your side. Your case deserves the best attention, which means a New York Criminal Attorney.

Abduction Suspect Found After More Than 25 Years

A Nevada woman, formerly of New Jersey, was arrested on suspicion of abducting her daughter during a custody dispute more than 25 years ago, authorities told a New York Criminal Lawyer.
The 57-year-old woman of Incline Village, Nevada, was arrested in October 2010, according to a New York Criminal Lawyer. She is accused of leaving a courthouse in Somerville, New Jersey, with her 6-year-old daughter, during a custody hearing on August 23, 1984.
During the hearing, the girl’s father had full custody of the child, New Jersey prosecutors told a New York Criminal Lawyer. The mother failed to appear for an arraignment on charges of interference with custody and a warrant was issued for her arrest on June 28, 1985.
There was no real break in the case until the daughter, now 32 years of age, attempted to change her name in order to obtain a marriage license. A background check revealed the daughter’s name in a list of missing children.
When the authorities came, the mother eventually admitted her true identity. As for the daughter, she apparently did not even know she had been abducted or that her mother was wanted by the police, sources told a Brooklyn Criminal Lawyer. It is not known why the daughter was attempting to change her name, either. New Jersey prosecutors will extradite the mother from Nevada. She was held at a county detention facility in Nevada on a no-bail warrant until the extradition is executed.
Your case before the court, whatever it may be, hinges upon your representation. Choose the best. Choose a New York Criminal Attorney. Your future depends upon who you have with you in your legal fight. Nothing less than a New York Criminal Attorney will do.

Couple Swallows Glass, Tries to Collect Insurance

A Massachusetts woman confessed the insurance claims she filed on her own behalf and her husband’s were actually false – their injuries were self-inflicted, a New York Criminal Lawyer has learned. They had eaten glass particles, purposefully, as a part of their scam.
The woman pleaded guilty to a 23-count indictment charging her with fraud and conspiracy, among other offenses, sources told a New York Criminal Lawyer.
Allegedly, the couple had collected more than $200,000 in compensation by filing insurance claims against hotels, restaurants, and grocery stores, claiming the food they had eaten or bought from these places contained glass particles. This all occurred in a period between 1997 and 2005.
The woman’s husband pleaded guilty back in 2007 and has already been sentenced to more than five years in prison. The woman herself will be sentenced in December. Prosecutors told Brooklyn Criminal Lawyers the couple also accumulated a debt of $100,000 for medical services, thanks to the glass they ingested as a part of their scam. These bills remain unpaid.
No matter how open and shut the case might seem to be, a New York Criminal Lawyer is still vital when the time comes to meet prosecutors. Long before the trial begins, representation is important and it remains important, even after sentencing, should the case come to that. It is a right given to every American and it’s important that right not be abridged, so no one is given a sentence that is more than what is deserved.

Braylon Edwards Arrested for DUI

Braylon Edwards, wide receiver for the New York Jets, was arrested in New York at 5:15 a.m. on September 21, 2010 for driving under the influence, according to a New York Criminal Lawyer.
The arrest followed a big win against New England on Sunday and a charity event. He was pulled over in New York City, early in the morning and registered 0.16 on a Breathalyzer test – twice the limit New York legal driving limit for blood alcohol content, according to a New York Criminal Lawyer.
Should the arrest lead to a suspension, this could mean some big changes for the Jets. Their passing game will have to change, as will their style of offense. Another top receiver on the Jets is already on the bench for violating NFL rules, which means putting the pressure on other players. The Jets may have to run the ball a lot more than they’re used to.
The Jets recently saw quite a bit of controversy due to the much-publicized Inez Sainz incident. Brooklyn Criminal Lawyers also know this is not the first time there has been trouble for Braylon Edwards. His fans know this could be a major problem for the Jets in the future, should he end up being absent during the season, even if it is only for a few games. The results of his arraignment are not yet known, as if this writing. Whatever the result, it is sure to be momentous for the New York Jets and their fans.

Manslaughter Conviction Overturned, Due to iPhone

The defendant had already been convicted of manslaughter for killing his neighbor by the jury, according to a New York Criminal Lawyer.
One of the key concepts in the case, included prominently in the jury instructions, was “prudence”. Specifically, they were asked to determine whether the defendant acted in prudence when it came to the victim.
The jury foreperson used his iPhone to access an Encarta and look up the word “prudence”, during a break from deliberations. He then shared this information with the other jurors, sources told New York Criminal Lawyers.
Once the defendant learned of this, he filed a motion seeking a new trial and was denied. Then, he tried to get review from the Court of Appeal of Florida. The appeal court reversed the decision, declaring the defendant was entitled to a retrial.
According to the appellate court, the concept of “prudence” may have been the subject that turned the case one way or another. Using the phone was just the same as using a dictionary and dictionaries are disallowed in juror deliberations. Their statement read in part that they could “not say there [was] no reasonable possibility that the … misconduct … did not affect the verdict in this case.”

Potential Witnesses Executed Near Nightclub

Two young men who may have witnessed two murder were shot execution style in a parked SUV after a night of clubbing in Manhattan, a New York Criminal Lawyer reports. The two men, 26 and 22 years of age, both of Coney Island, were shot in the head not long after leaving a posh Manhattan hot spot.
New York Criminal Lawyers still do not know the motive behind the shootings. Police had questioned the 26-year-old victim about the death of a Coney Island grandmother who was killed by a stray bullet, while the younger man was asked about his brother’s murder in 2009.
Neither one of them said they would comply with police requests, sources told a New York Criminal Lawyer. Police believe the pair may have gotten into trouble while inside the club. Both of them had a history of criminal activity and a number of people who may have wished them harm.
“Both are known gang-bangers who are involved in many things, and their business is likely behind their execution – not the fact that they were potential witnesses in other homicides,” sources told a New York Criminal Lawyer.
There is security camera footage that shows a dark sedan pulling up behind the victims’ silver SUV. Two men emerged from the sedan and disappeared from view as they approached the SUV. Moment later, they returned to the car and drove away quickly.
Neither one of the victims were very cooperative with the police when it came to finding the perpetrators of the murders they may have witnessed.
No matter what your history with the law may be, the services of a New York Criminal Attorney are invaluable. If you find yourself on the wrong side of the law, a New York Criminal Attorney is ready to assist you.

Drug Bill Attempts to Reduce Overdose Deaths

There are some heroin addicts who are lucky enough to have friends call 911 when they happen to overdose. There are many more whose friends are afraid to call the authorities for fear of arrest, experts told a New York Criminal Lawyer.
A Long Island organization is attempting to change that by lobbying for a law which would give limited immunity from prosecution for possession of a small amount of drugs or alcohol for minors, to people seeking emergency medical attention for someone who is overdosing, a doctor announced to New York Criminal Lawyers.
“There’s a one- to three-hour window before an overdose becomes a fatality,” the doctor related to a New York Criminal Lawyer. “It’s enough time to save a life.” He concluded by saying most overdose victims survive if they receive medical attention in time.
The proposed law was introduced by two Manhattan Democrats, a state senator and a state assemblyman, but it was stalled. The Long Island Council is hoping to get the bill passed in its latest session.
“We can’t go through a long, hot summer where we’re losing kids needlessly,” said the doctor.
The bill has limitations. Anyone with an outstanding warrant or drug dealers or those who possess large amounts of drugs would still be subject to prosecution, according to New York Criminal Lawyers.
If you or a loved one have difficulties involving criminal activity or criminal law, a New York Criminal Attorney can assist you through trying times. A New York Criminal Attorney can bring your situation to its best possible resolution.

Robbery Unfolds and Unfortunately a Man Was Killed

The teacher’s wife said that her husband often played poker to relieve some of the stress he felt from raising a special needs son. The man’s son is 19 but requires a considerable amount of time reports a Brooklyn Criminal Lawyer.

The two men shot and killed the man during the foiled robbery attempt and much to the surprise of anyone; they are expected to be sentenced to 25 years to life. The sentencing is scheduled for June 22. The gambling den was in an underground facility report Brooklyn Criminal Lawyers. During the robbery the two men were able to take $20,000 in cash.

One of the men fired a sawed-ff shotgun in the room, which hit the 55-year schoolteacher. The man’s wife was extremely upset and indicated that she hated to wish anything on anybody but she felt that the men brought this on themselves. As the man’s wife spoke, she indicated that there is no winner in the case as her husband is gone regardless of what happens to the two men. New York Criminal Lawyers report that one of the men had already served eight years in prison for manslaughter.

Statutory Rape is explained and discussed in detail

The crime of Rape and its many variations are in the rise not only in New York, but nationwide. Statutory Rape is generally defined as an individual having sex with a victim that is under the age of consent. The age of consent varies from state to state, in New York the age of consent is 17 years old. Often a charge of Statutory Rape is brought by the parents of a minor child; however the state can bring charges as well, even if the parents do not. It is important to realize that even if a person has sex with someone under 17 who gives their consent; it is still considered Statutory Rape. Also know that being mistaken or unaware of the victim’s age is not a defense to this crime. If you have been accused of Statutory Rape, it is important to seek legal advice right away. The charge of Statutory Rape (even if it is not true), can have a very real and long lasting effect on the accused life. If you are convicted of this crime, you could receive a jail sentence, and the imposition of substantial fines, just to start. In addition to the public embarrassment these charges create, it is also possible that you would need to register as a sex offender. A skilled New York Statutory Rape Lawyer can make all the difference in how your matter proceeds.

The crime of Statutory Rape is defined in New York Penal Code Section 130. Which particular provision that will apply is dependent on the age of the victim, and the age of the defendant. There are three degrees of this offense. If the defendant is 21 years of age or older, and the victim is under 17 years of age, the crime would amount to 3d degree rape, which is classified as a Class A misdemeanor. A misdemeanor is punishable by up to a maximum of one year in jail. If the defendant is over the age of 18 and the victim is under the age of 15, the crime is classified as 2nd degree rape, which can be a Class B or Class D felony. A felony is punishable by anything over one year in prison. If the victim was under the age of 11 years old the crime is considered 1st degree rape, and is classified as a Class B felony.

If you have been charged with a Sex Crime, including Forcible Touching, Child Pornography, or Sexual Abuse, it is extremely important to contact a New York Statutory Rape Lawyer as soon as you can. Embezzlement is explained and examined as a complicated crime

A New York Embezzlement Lawyer will explain to you that Embezzlement is defined as wrongfully misappropriating money or property that has been put in a person’s care but is rightfully owned by someone else. This crime is distinguished from Petite Larceny which is the taking of property below the dollar amount of $1,000., or Grand Larceny which is the taking of property valued at over $1,000. If the District Attorney finds that you in fact guilty of Embezzlement, the punishment imposed upon you by the judge can be substantial. If you have been charge with Embezzlement, it is advised that you call a New York Embezzlement Lawyer at your first opportunity.

As mentioned above, the crime of Embezzlement means that a person, who has responsibility for a certain item of property, takes that property. The concept of Fraudulent Conversion may come into play here as well. Conversion is the crime of taking ownership of property that has been left in your care, and using it for your own benefit (in a way that is not authorized). In order to prove Embezzlement, the following elements must be present: (1) the property involved belonged to someone else; (2) the property was converted or used for the defendant’s purposes; (3) the defendant was in a position of trust and possessed legal possession (or access) of the property; and (4) the defendant knowingly defrauded the owner of the property.

The crime is commonly seen in an employer/employee relationship. But it can be seen in other contexts, where a fiduciary relationship exists between the defendant and the owner of the property. Embezzlement is considered a White Collar Crime. This is a collection of crimes that have the common denominator of fraud. Often these crimes can overlap (Mail Fraud, Bank Fraud, and Computer Fraud, for example). Because of this the District Attorney will examine business records to determine the extent of the fraudulent activity. These matters can be far reaching and complex, and such it is important to have the support of a Brooklyn Criminal Lawyer to help you through your case.

The penalties for Embezzlement will vary depending on what the dollar amount is of the stolen property. You may be punished with restitution, fines and possibly prison. If you have been charged with Embezzlement, there can be a lot at stake, and you will need a New York Criminal Lawyer protecting your interests.

A Brooklyn Criminal Lawyer Talks about The Crime of Arson

In New York, Arson is considered a serious offense. This is partially due to the unpredictable nature of the crime, which can cause substantial damage to property and physical injury. In New York, there are five degrees of Arson.

Arson is generally defined as willfully and maliciously setting fire to property or a structure without the consent of the owner. The degrees of arson are categorized by what type of property was set on fire, if there was any risk or injury to people, and the different types of fire that are set.

A New York Arson Lawyer will explain to you that the New York Criminal Court and the District Attorney have traditionally had a strong reaction to arson cases, because of the dangerous nature of the offense. Your bail may be higher for this offense than for other offenses such as Assault, Petite Larceny or DWI. Because of this, it is extremely important that a defendant accused of an arson offense obtain the advice and counsel of the qualified New York Arson Lawyer prior to your Arraignment. A qualified lawyer can help you to navigate through the potentially complicated legal situation at hand.

Depending on the degree of Arson you are being accused of, you may receive a Desk Appearance Ticket. Do not be lulled into thinking that because you were not held in jail your offense is not as serious or that you should not have a lawyer. The receipt of a Desk Appearance Ticket only means that while you were technically arrested and processed, you do not have to stay in jail awaiting your Arraignment hearing. It is important to remember however, that you must attend this hearing, as failure to do so can result in a Bench Warrant.

Arson is categorized by degrees. Arson in the first degree is considered an A Misdemeanor offense. The other degrees of Arson (second degree through the 5th degree) are considered a Felony offense. Arson in the 1st and 2nd degree are categorized as a violent Felony.

It is important to discuss your case with your Brooklyn Criminal Lawyer if there are any affirmative defenses available to you. The existence of an affirmative defense may lessen the severity of the charges against you, or even result in of the dismissal of your case.

If you are facing an arson charge, it is important to have a New York Arson Lawyer to help you deal with this difficult situation and make sure that your rights are adequately protected.
