Police Officers Shot at in Drug Case, states New York Criminal Lawyer

Two police officers spotted a 26 year old suspect smoking marijuana at 6:15 PM at a street corner, a New York Criminal Lawyer said. The officers approached the suspect and attempted to place him under arrest when the suspect became unruly and decided to resist arrest. The officers were attempting to handcuff him at the time he opposed them. The suspect then somehow managed to gain access to the gun of one of the officers and tried to fire a bullet. A struggle then ensued with both suspect and officer attempting to gain possession of the weapon. The officer did manage to keep one hand on the barrel of the gun before the gun was fired.

The suspect discharged the gun once and although firing at point blank range, the bullet did not strike anyone or cause any damage. The suspect was attempting to fire a second time but was unable to do so because the shell casing was jammed inside the gun.

The officer was then able to regain full possession of his weapon after a major struggle and the suspect was handcuffed and placed under arrest without further incident. Charges against the suspect and further information is still pending at this time.

Both officers, however, had to be taken to the hospitall for injuries sustained in the altercation. One of the officers suffered an injured elbow. The other officer was treated for injuries to both his back and shoulder.

A growing local church in Palm Beach Gardens faces economic woes

A non-denominational community church was recently threatened with foreclosure following verification that it owed $11.3 million in principal, as well as substantial interest and moderate late charges, as reported by a New York Criminal Lawyer.

The non-profit community church in Palm Beach Gardens was cited for a possible foreclosure along with its fellow tenants, including a construction company and a real estate counseling firm. The principal amount owed by the church stemmed from a past loan from a local bank in 2006, and the case was heard in the Palm Beach County 15th Judicial Circuit. The non-profit community church originated in a former cinema complex in Palm Beach Gardens, and in 2008 upgraded to its current location, a retail/office/entertainment complex. Connecticut Legislature Considering New Medical Malpractice Bill

Testifying before a Connecticut State Legislature committee, a widower was finally allowed to tell his story about how his wife’s psychiatrist had contributed to her suicide more than seven years before, a New York Criminal Lawyer learned. This 46-year old man claims that after taking antidepressants the psychiatrist prescribed, his wife had suicidal thoughts. He went on to say that, her psychiatrist literally ignored his calls as he tried to get her help. His 46-year old wife eventually backed her car into the couple’s garage and left the engine running. Her death was a suicide by carbon monoxide poisoning.

While his wife’s former psychiatrist and his license remain in good standing in the state of Connecticut, and his attorney flatly denies the allegations, the husband of the dead woman has been on a quest ever since his wife passed away. Detective arrested for driving under the influence

An Alexandria Police Department detective faces driving under the influence charges after he was involved in a single car accident. He crashed his city-issued vehicle into a concrete pole. The car was provided to the department with taxpayer money. The accident happened at the corner of Gibbon and South Patrick Streets in Alexandria, a New York Criminal Lawyer was told.

The detective, who was off-duty at the time of the accident, refused to take a breathalyzer test when the police arrived about 6:30 p.m. Saturday at the accident location. He is also facing charges of unreasonable refusal for rejecting the breathalyzer test.

The mayor of the city said the incident could not be tolerated. “It doesn’t represent the characteristics of the hundreds of outstanding men and women of our police department. Hopefully, this is just an isolated incident,” said the mayor.

He was taken to an area hospital to be treated for injuries related to the accident. The injuries were considered minor.

The detective’s court date has not been officially scheduled, but he is on paid administrative leave. The department is running an internal investigation into the DUI said the department’s spokesperson.

This is not the first DUI incident the department has faced. Back in 2009, the former police chief was arrested in Arlington after drinking drunk. The current police chief, who replaced the former one after he was arrested, and the city manager may be taking a closer look at the department’s policies to keep DUIs from occurring again, explained a New York Criminal Lawyer.

Pass the Spittoon—Man Spits on Floor in Courtroom

A twenty year-old man from Macomb faces charges for driving under the influence, marijuana possession, and a possible charge for contempt, as he spit on the floor in the courtroom during his hearing. The Illinois State Police arrested the accused early on Sunday, where he was driving with a suspended/revoked license, found to be in possession of marijuana, and driving under the influence of drugs.

Since the man failed to appear in court in the past, he is also wanted in the state of Tennessee. His hearing was held on Monday at the McDonough County Circuit Court, where in order to be released he would have to post $450 to make bail, but he claimed that he could only account for $300 total. The man seemed outwardly troubled, as he shared about the difficulties of traveling place to place, and struggling with family problems. A New York Criminal Lawyer expounds, that while the man was walking toward his seat in the courtroom, he allegedly spit on the floor, and was later questioned by the Sheriff's deputy as to whether this was an accident or not.

After the accused was dismissed, an assistant county prosecutor filed an appeal that the act of spitting was a direct sign of contempt toward the court. No ruling has been made yet, regarding the petition against the accused for spitting on the floor. The man is currently residing in the McDonough County Jail, until his next hearing on Wednesday.

Landlord Running Over Tenant Recounts New York Criminal Lawyer

Taking the law into one’s own hands is never the best way to handle a situation. People tend to get hurt and once the actual legal system gets involved the process may become overwhelming. Though the case has been forwarded to prosecutors, no charges have been filled as of yet. The 73 year old owner of the duplex in which the tenant lived ran over a man he said was standing behind his vehicle and refusing to move. West Fargo police state that Cass County prosecutors may charge the vehicle driver with aggravated assault. The tenant remains hospitalized and has been unable to speak to detectives following his injuries. In fact it is likely that the hospitalized man will not be able to speak to detectives for several more days.

The landlord told reporters that he felt threatened and scared by some man standing in the road who would not move. The landlord then states he saw another person coming up behind his vehicle and the fear was magnified. This all took place around 7:15 P.M. in the 600th block of Second Avenue West while the landlord sat in his Hummer.

Witnesses share a different story as two separate people state that the landlord struck the tenant on purpose, knowing where he was and who he was. Man Held as Material Witness in Terrorism Trial Sues Former Attorney General

A man held for 14 days in 2003 for alleged ties to a terror suspect has filed a lawsuit against a former Attorney General. The man claims that he was stopped at Dulles International airport in Virginia and taken to various places throughout Virginia, Oklahoma and Idaho for questioning. During these sessions, the man was grilled on various subjects including his religious beliefs, ties to terrorism groups inside and outside the United States and his relationship with the terror suspect police officials had in custody, reports a New York Criminal Lawyer. The man was eventually released and never had to appear as a material witness. The other man's trial resulted in an acquittal in 2004.

The man, a U.S. citizen, converted to Islam while attending the University of Idaho. It was there that he struck up a friendship with the other man accused of terrorism. On that day in 2003, the man was on his way to Saudi Arabia to learn more about his religion, study the language and learn more about the culture when he was detained at the airport. The man currently lives in Saudi Arabia and is being represented by the American Civil Liberties Union (ACLU).

This case will probably end up being heard in front of the Supreme Court. While most agree the court will side with the Attorney General, some believe the decision to do so will be a tough one. The man's case rests on the fact that he was wrongfully detained as there was no evidence he was a part of any criminal activity or that he knew of any terror plots against the U.S., explains a New York Criminal Lawyer. The man also claims that law enforcement coerced him into answering questions because they told him he was to be a material witness during the other man's trial.

Newly appointed Supreme Court Justice Elena Kagan has recused herself from this case since she used to be President Obama's solicitor general. The remaining justices will hear the case and make their judgment based on the evidence presented. This is relatively new legal territory as the Supreme Court has heard few of these types of cases since 9/11. They must take into consideration the political climate at the time and the rights of the man suing former Attorney General Ashcroft. Barry Bonds on Trial for Allegedly Lying to a Federal Grand Jury

The trial of former major league baseball player, Barry Bonds, is underway in U.S. District Court, a New York Criminal Lawyer has learned. The former San Francisco Giant all-star is accused of “obstructing justice and three counts of making false statements to a grand jury.”

During their opening arguments to the jury, prosecutors stated that when Bonds testified to the grand jury in 2003 that he had immunity and that all he had to do was to tell the truth, which they allege that he did not, the New York Criminal Lawyer was told. His testimony was in regards as to whether he had knowingly used anabolic steroids, which Bonds denied. Bonds baseball career was essentially over when he tested positive for “banned substances” during a team administered urine test. He has not played major league baseball since he was indicted in 2007.

One of those expected to testify against Bonds, is his former mistress who will reportedly testify that Bonds told her that he suffered from sexual dysfunction due to steroid use. His mistress was reportedly with the former ball player for more than 10-years and during two of his marriages.

As part of the courtroom drama unfolded, the presiding judge sent the jury from the room while she sentenced Bonds’ former personal trainer to jail for contempt of court for his refusal to testify. She went on to add that he would remain in jail until he chooses to testify. His lawyer has appealed the contempt charge, sources told a NYC Criminal Lawyer. Prosecutors contend that the former trainer is one who provided Bonds with illegal steroids and growth hormone injections.

Accusations of drug possession and steriod use in sports are nothing new. The first instance was just before the 1954 World Weight Lifting Championships. Rumors abound that before Mark McGwire broke the record that a bottle of “supplements” was seen in his locker. He retired soon after. Officers Take Out Meth Lab, Arrest 4 in Lexington County

Acting on a tip, officers from the Lexington County Multi-Agency Narcotics Enforcement Team (NET) raided a home near Lexington, SC, led to the arrests of two men and two women, sources revealed to a reporter.

A Lexington County Sheriff’s Department spokesman said that NET officers had received a tip that the four persons were manufacturing meth at a clandestine meth lab in the home of one of those arrested. Officers from the multi-agency cooperative effort executed a search warrant just after 2:00pm Friday and found that meth was being manufactured in the master bedroom. Officers said that a small amount of marijuana was also located inside the home.

Local firefighters from the Lexington County Fire Service were on the scene and assisted the officers to dismantle the meth lab and to assist with the disposal of any chemicals and other hazardous substances that were associated with the meth lab.

Those arrested have been charged with multiple drug related charges including distributing meth, manufacturing meth, possessing marijuana, and possessing illegal narcotic drugs. All of those arrested are currently being detained in the Lexington County Detention Center, where they are awaiting a bond hearing.

Methamphetamine, a form of amphetamines, in various forms has been around since it was first discovered in Japan in 1919. The patterns of abuse have persisted in New York and Suffolk ever since Methamphetamine abuse can be extremely debilitating, and has caused many problems over the years. This powerful narcotic stimulates the central nervous system after the user smokes, snorts, orally ingests, or injects the drug into their system. Murder and DUI Suspect Had Been charged 50 Previously

A man accused of killing a mother and grandmother while being high on crack cocaine had fourteen prior arrests at the time of the fatal crash, claims a police report.

The man's drug abuse was well known to local authorities before the accident in which he struck and killed a mother and grandmother with his Chevy Tahoe. The 30-year-old man had faces charges 14 times prior to the January 6, 2011 crash.

The man has faced a variety of charges, including possession of a controlled substance and marijuana. The man was arrested several times for driving with a suspended license and with a revoked license, reports a source. In total, the man has faced 55 charges since 1999.

According to authorities, the man was hospitalized with a broken pelvis and two broken ankles. He is currently under house arrest at his home and is equipped with an electronic monitor so authorities can track his whereabouts. He was not taken to jail upon release from the hospital because the jail is not equipped to care for his injuries. The jail only has two to three medical staff members to serve approximately 1300 inmates housed at the jail. The man is currently bed-ridden and required constant care. As soon as he has sufficiently recovered, he will be moved to the jail, according to authorities.

The man faces two counts of murder, possession of cocaine, two counts of assault and driving with a revoked license.

Federal program uses fingerprints to identify illegal immigrants

In an effort to more easily identify illegal immigrants who have committed crimes, there is a new federal program that uses fingerprinting, using federal databases, to do so, explains a reporter. This program is being adopted by states all across America in an effort to nab illegal immigrants who have been convicted of a crime like drug possession to make it easier to process them. This program is said to be implemented across the entire U.S. by 2013.

Opponents of this program say that such measures are unnecessary, but police and law enforcement all agree that it makes the task of prosecuting illegal immigrants who have previously committed crimes much easier, reports the insider. A routine traffic stop could turn bad for any one of America’s millions of drivers, especially if they have a warrant out for their arrest and they are caught with cocaine in their possession. Why should it be any different for an illegal immigrant?

With the plethora of new laws being made to keep catch perpetrators of crimes, it can sometimes seem a little overwhelming, but law enforcement continues to insist that these new technological advances and programs are necessary to keep peace on our streets, explains the source. Supreme Court denies overturned conviction for ex-felon

The Supreme Court rejected an appeal that would have overturned a conviction of a Washington state man. The man is an ex felon who was appealing a law that would send him back to prison for several months.

The man was pulled over by police in 2005. They told a reporter that they suspected that he was selling cocaine. Police also realized he was wearing a vest. If police suspect a person is breaking the law, they have the right to pull an individual over.

The court rejected his appeal over a federal law banning convicted felonies from having body armor. This also includes bulletproof vests. A 7-2 decision by the Court to not review the case determined that they would not intervene with the decision for the man to be sentenced to 18 months in prison. They decided to stick with the original verdict. Drug possession was certainly the contention of the law enforcement group.

The 2002 law made it illegal for convicted felonies to have armor or vests. The law was proposed during a time where many high-profile shootings were occurring involving police officers. Many of the shootings occurred during bank robberies. The law was proposed to prevent more officers from being killed.

If the man had not been an ex-felon, he would have not broken federal law. It is a federal matter because he was stopped in Washington for suspicion of selling cocaine, but the police officers noticed the vest which had been manufactured in California, explained a spokesperson. He was convicted of armed robbery in 1999.

Immigration Detention System Shows Ugly Flaws in North Carolina

A 30-year-old immigrant, married to an American woman, with a very young son, was arrested on September 28, 2009, taken from his family home in Durham, North Carolina, a New York Criminal Lawyer reported.

“I was scared, but in the back of my mind, I just felt that everything would eventually be OK because I was a citizen and he was married to me,” said the immigrant’s wife. She is a mental health therapist, born and raised in the United States.

It’s been more than a year and a half and every request for release on bond has been denied, thanks to two misdemeanor drug possession charges from 1998. The authorities feel these charges make him a flight risk, which means he stays in prison until they make a final decision, according to a Bronx Criminal Lawyer.

While this particular man has a lawyer, many of the detainees in ICE facilities never get the chance to see one, because their facilities tend to be in isolated locations, which makes the acquisition of an attorney much more expensive. The man in question is nine hours from his home and two hours from his own attorney.

“Unlike in the criminal system, where if someone can’t afford a lawyer they’re appointed one, in the immigration system you have a right to a lawyer, but you have to find and pay one for yourself,” a representative of the National Immigrant Justice Center tell.

Fortunately, the wife of the North Carolina immigrant can hire a lawyer, but many detained in similar circumstances cannot. She gets the money from her mother and grandmother, who have paid $14,000 so far, and that might only be the beginning. There are also travel expenses, application fees for immigration forms, and counseling fees for wife and son.

“If it wasn’t for them, we would probably be out of the country,” said the wife, referring to her mother and grandmother.

The immigrant did illegally enter the country, but at the age of eight, brought by his mother. Eventually, he gained a work permit of his own. But because he entered the country as a minor, his immigration status relied on his mother’s status. She was denied permanent residency in 2008, which invalidated her son’s immigration status. When Immigration Services sent him a notice to appear in court, it was sent to the wrong address. They later admitted their mistake but only after the man was arrested and ordered deported.

Cocaine smuggler ends up with egg on his face

It is amazing the things that people will try to get away with when it comes to smuggling drugs into our country. Immigration and customs agents see it every day. People come up with the most hair brained schemes to get their drugs through customs, to the point of absurdity. According to a reporter, one man tried a playful approach, but ended up with egg on his face after all.

The 23 year old Florida man flew into LA International Airport with a suitcase filled with plastic Easter eggs. When Immigrations officers became suspicious, the man tried to play off the incident, saying that the toy eggs were filled with candy and he was taking them home to his children, despite the fact that Easter was months away. Officers searched the suitcase and lo and behold, there was candy in those eggs, alright, but not the kind of candy one would give to a small child.

Reports from the court said that police cracked open the plastic eggs to discover 14 pounds of cocaine, estimated to be almost $100,000 worth on the street. Why the man thought that his story would fly is beyond most of us. Surely the TSA has proven to us again and again that it is difficult enough to slip through security with a bottle of water, so why try to sneak through such a large quantity of cocaine? Needless to say, the candy man ended up going to jail with more than a little bit of egg on his face.

Man’s sentence for fatal DUI drops from possible 30 years to 120 days

A Massachusetts man has been given the gift of learning a hard life’s lesson but at much less cost after a plea bargain his lawyers initiated landed him serving a mere 120 days at a Vermont prison work camp after a fatal car accident in which his friend was killed. The 24 year old man was DWI last March when the accident occurred.

Reports said the man lost control of the car, sending it off the road and rolling off to the side. The passenger, a friend of the man, was thrown from the vehicle sustaining fatal injuries. He died later that night at the hospital. Though family and friends were devastated over the man’s death, they rallied around the 24 year old driver and supported him. Those closest to him said they knew that he was not a criminal, but had chosen to make a very bad decision on the night that he got drunk before he got behind the wheel. Drug possession was not a part of the scene.

The worst case scenario could have been 30 years in prison for the driver, but in the end the judge saw fit to give him a new lease on life by allowing him to attend a prison work camp instead of doing hard time. In this case, a man who made a tragic mistake that he will have to bear for the rest of his life gets another chance to live according to a higher principle.

A source familiar with the high profile attorney's legal record said the special prosecutor prosecuted Paris Hilton following her cocaine arrest a year ago. The special prosecutor was the attorney of record in the prosecution of rising star Bruno Mars on drug possession charges.

Authorities said that the special prosecutor was being investigated on allegations that he regularly bought $40 worth of coke every week from a street dealer. His arrest came as a result of being seen buying the drug on the street. The special prosecutor's BMW was idling on a Las Vegas street where law enforcement observed a possible drug buy taking place. The arrest report said that the special prosecutor picked up an African American male at one apartment building and dropped him off at another building. Then the special prosecutor allegedly drove around before returning to the same drop off site and picked up the same man. When authorities pulled the black BMW over the suspected drug dealer fled from the passenger side of the vehicle. One officer gave chase and apprehended the suspect, a resident of Las Vegas.

The suspect informed arresting officers that he knew the special prosecutor as "Joe". He told them further that "Joe" had been buying coke from him regularly for the past seven months to the tune of $40 per transaction four times every week, authorities told an NY Criminal Lawyer.
The special prosecutor is in a lot of trouble. His computer has been seized and he has been suspended from his prosecutor's job with the District Attorney's office in Las Vegas. It is not clear whether he has compromised other cases he has prosecuted for the DA. The special prosecutor may have violated the integrity of a number of cases he was handling by association with the drug task force he was running as part of his job. His immediate supervisor, DA Rogers, has revoked the special prosecutor's badge and is seeking a replacement for the long time prosecutor as soon as practicable.

Alabama House of Representatives Passes Arizona-style Immigration Law

The Alabama House of Representatives voted 73-28 on April 5, 2011 to pass an immigration law very similar to the controversial one passed in Arizona. It gives law enforcement officers the ability to detain people on the suspicion of being in the United States illegally.
The sponsor of the bill confirmed that the bill “attacks every aspect of an illegal alien’s life.”
“This bill is designed to make it difficult for them to live here so they will deport themselves,” the bill’s sponsor stated. The bill will go to the Senate, now that it has been passed in the Alabama House.

The sponsor of the bill claims illegal immigrants cost taxpayer money and take jobs American citizens would otherwise be working. Opponents, however, insist the bill will result in racial profiling and make law enforcement more expensive. In their opinion, immigration enforcement is the job of the federal government. The supoprters of the bill believe that undocumented workers are responsible increased crime including drug trafficking, various theft crimes including robbery, sex crimes as well all types of violent felonies.

The bill, if passed, would require law enforcement officers to obtain proof of citizenship or residency from anyone they stop for minor incidents like traffic violations, if there is reasonable suspicion that the suspect may be in the United States illegally. The officer would have to make an attempt to ascertain the suspect’s legal status and those believed to be in the United States illegally would be detained and charged with trespassing.

Jails would be able to hold people until their immigration status could be verified. The bill would also make it illegal to give an illegal immigrant a home, to give them a ride, to rent to them, or employ them.

“Help me understand this reasonable suspicion. Do I look American?” an opposing representative asked the bill’s sponsor.

The sponsor replied that “reasonable suspicion” would include someone without identification who acted nervous or who changed their story while speaking with an officer. He also assured citizens that officers could not pull someone over or detain them solely on the suspicion of being in the country illegally. They would have to be pulled over for another matter first.

Alabama could have as many as 120,000 undocumented persons living in the state as of March 2010, which is double the number from just five years ago.

Police Charge Two Homeless Men in Long Island with Eight Burglaries

It was all about a heroin addiction with two homeless men, Suffolk police told a source. They committed a number of burglaries to pay for their expensive habit and are charged with drug possession.

The two men, 41 and 42 years of age, were arrested by police, following a chase. The police were tipped off after a witness saw the pair breaking into a home in Dix Hills.
Police said the two men are suspected of committing eight burglaries. Seven of them were in Dix Hills, and they attempted two others.

According to the police lieutenant, they were not only charged with the burglaries, but two counts of second-degree assault, four counts of second-degree criminal mischief, resisting arrest, and unlawfully fleeing a police officer. The police chased the pair to a dead-end street, where their car, a Chevrolet Blazer, tried to bull through four marked police cruisers, as the suspects attempted to escape.

The police lieutenant said that two officers were injured during the arrest. One sprained his wrist and fingers. He did not detail the extent of the injuries the other officer suffered.
The 42-year-old suspect was held on $365,000 bond or $182,500 cash bail when he was arraigned at First District Court in Central Islip.

The second suspect was sent to the hospital with undisclosed injuries. Any information about his arraignment is also currently unknown. Police say both of these men suffered from a drug habit. The entire point of the robbery was to get money to buy more drugs.

“Anything they could steal, really,” the police lieutenant said. “They were looking for cash or items they could sell quickly.”

Witnesses had already given police information to find the two men, learning more in the last sighting that led to the final arrest of the suspects. Police tried to stop the burglary, but instead were led on a chase, according to the police lieutenant. The pair fled at high speed, tracked by both police cruisers and a helicopter.

Police in New York and Suffolk County encounter similar types of crime involving drug use and robbery.

Pot Smoking Toddler’s parents arrested

A group of citizens told a New York Criminal Lawyer that a couple was blamed for having videotaped their toddler who is 23 months old and was allegedly smoking pot. The couple was arraigned in court for charges of negligence.
The police told reporters that they got a tip about the incident from an anonymous person. The Sheriff of the country went to the accused couple’s home and found the twenty year old mother and 24 year old father of the child. The police said that the video did, in fact, show that the toddler was smoking pot from a pipe. This incident occurred about three times. The pipe had residue of marijuana in it as seen on the video. The video has become the main evidence in the case and will be kept into evidence and not released.
The parents were charged for child cruelty and neglect. An investigation into the case was done and that was when the couple was officially charged. Both parents were not booked at the same time. The mother was brought into custody first and then the father surrendered the next day.

Both parents were held in jail on a bail of $100,000. According to law enforcement, the parents seem to be remorseful for their behavior and have since understood that they did not make a good decision in this case. According to law enforcement investigators, both parents owned medical marijuana cards. The toddler was taken away from the parents and put in custody. In the Bronx and New York this behavior is not condoned by the courts.

New Illegal Immigrant Policy at the US-Mexico Border

In Arizona, the controversy continues surrounding the status of illegal immigrants. Despite recent legislative changes in the treatment of illegal immigrants, little has been solved regarding the treatment of these people who are living in the United States illegally. The United States Border Patrol has enacted new policy which includes sending illegal immigrants back across the border.

The new unofficial policy is to send anyone illegally crossing the United States-Mexico border to be sent back to Mexico instead of being arrested. Local law official say that sending people back to Mexico does little to solve the problem; they report that people tend to make multiple attempts to cross the border if the first attempt is unsuccessful.

There are some accusations that the new policy is politically motivated. The theory is that the change in policy is attempting to keep the number of border arrests down to improve the security statistics. By sending the border crossers back to Mexico, the number of arrests along the border has decreased and politicians are using this statistic to suggest that the US-Mexico border has become more secure.

Local law enforcement does not appreciate the new policy as the lower number of people being arrested may cause an increase in the number of people attempting to cross the border. They suggest that this increase in attempts actual decreases the security of the communities near the border. The lack of consequence for illegal entering the country may promote the idea that there is little or no consequence for breaking federal laws.

While immigration has always been a particularly complex issue in the United States, the new policy further complicates the legal process. The selective arresting of some border crossers while others are simply turned back calls into question the fairness of the process.Many supporters of the bill believe that the undocumented people are involved with the smuugling of a variety of drugs ranging from marijuana to heroin as well as a illegal guns.

Federal officials have officially denied that this is a new official policy; however, many people in the organization have said that they were given these orders. Family charged for Illegal Entry to the US

A distressed mother of an alleged 14-year-old alleged murderer has just been charged with entering the United States illegally, according to New York Criminal Lawyers and is facing deportation.

The 43-year-old suspect was arrested with her husband and taken from their apartment, where they lived for nearly eight years to be federally charged with illegal re-entry after previous deportation according to local police reports.

In 1997, the mother was originally deported for possession of rock cocaine according to police reports. No records indicated that she applied to be reinstated to the United States. Her husband was originally deported back in May of 2002.

It is unknown what prompted the arrest, but Lawyers said the couple was arrested and taken away in front of their other elementary school-aged children. The children were also taken from the couple at the scene.

The 14-year old alleged murderer, who admitted to participating in at four beheadings, is currently in a protected location while Mexican Authorities search for evidence of citizenship and other details about the boy who was supposedly born in San Diego.

Authorities continue to investigate whether or not the two older sisters had ties to organized crime. They are currently being held in a Mexico City detention facility, New York City Criminal Lawyers report.

In a similar story, three men were arrested this week for possibly working for the same drug group located in Cuernavaca. Arresting army troops were led to an area where these men allegedly buried at least two of their homicide victims. Cases like this are common in Manhattan and Long Island.

Former Teen Star enter plea in DUI case

A Police Officer told a New York Criminal Lawyer about the DUI incident with celebrity and former teen star, David Cassidy, who was a singer and actor during the 1970s. The Police Officer indicated that the star is assumed to be ready to enter a please of guilty. He also have the option of entering a please of no contest. The sentencing hearing took place a few months after the incident and David Cassidy was charged with a DUI not drug possession.
The Police Officer indicated that on the day of the sentencing, the Judge declared a postponement of the sentencing. However, his lawyer opted to have him enter a plea in written format for the DUI charges against him. The police report indicated that Mr. Cassidy could not stay in his lane and when stopped, the police found open alcohol containers in his vehicle, which was in violation of the law.
The Police Officer explained to the NY Criminal Lawyer, “David Cassidy was allowed to not appear at the hearing because it was a misdemeanor charge and his lawyer would stand on his behalf and enter the plea for him. “
Reporters were anticipating that David Cassidy would have appeared at the sentencing hearing, but they were highly disappointed. David Cassidy lived in Fort Lauderdale, Florida and he was driving on the highway on a November evening, when the police pulled him over. His car had veered off the road and he almost caused a crash with the other vehicle behind him. He failed the breathalyzer test. Cases like Cassidy's are common in places like Brooklyn and The Bronx.

Court denies Ex Mexican police officer

A federal immigration judge denied an ex-police officer from Mexico asylum, a New York City Criminal Lawyer reported. The officer fled drug violence from Juarez, Mexico.

The ex-police officer’s case was heard late November 2010. The hearing was closed to the public at a federal immigration court in Dallas.

The 27-year-old ex-police officer said he refused to be bought off by drug cartels. His decision resulted in a gun battle in a city across from El Paso, Texas. The gunfight occurred in 2008. It is unclear if the man’s attorney will appeal the court’s decision, a reporter was told.

The increase in violence has sent many Mexicans seeking peaceful American pastures through asylum. Records show that there has been an increase for asylums being requested, an observer said. Few asylum requests are granted. If an individual is granted asylum, the United States would provide a refuge for the people to protect them.

Death tolls in Mexico have skyrocketed as Mexican officials are fighting to put an end to drugs. Many drug cartels have control over police efforts and they create fear in citizens. Mexico military and federal agents have been fighting against their own because of the corruption amongst the law enforcement. The drug war has made loyalties of people involved clear.

The federal Executive Office for Immigration Review spokeswoman said that the Dallas judge wrote an opinion about the case and submitted a letter to the review board. A copy of the letter was not disclosed to the public or the media in Staten Island and Suffolk, informed a New York Criminal Lawyer.

In Cape Cod, Retired Chief Probation Officer Arrested for Cocaine Trafficking

Investigators have seized the alleged client list of a retired chief probation officer after his arrest late last week, when he was charged with cocaine trafficking. The suspect was arraigned on Monday at the Dukes County Courthouse and pled not guilty to trafficking more than 28 grams of cocaine, a class-b-substance, according to court documents found by a New York City Criminal Lawyer.
The suspect’s ledger allegedly contained the names of 20 persons, along with corresponding coke order amounts and drug debts. The Sargent further revealed that police have been getting tips about the suspect “for years.”
The 65-year-old former probation officer was arrested by members of the Martha’s Vineyard Drug Task Force and Oak Bluffs Police Department on Friday, March 18 at approximately 4:30 p.m., after they arrived, armed with a search warrant, to search the suspect’s property. Officers at the scene found 39 packages of cocaine on the suspect and on his property, and also found cutting agents used to package the cocaine, according to court records obtained by investigators from The Bronx and Westchester County.
The suspect served 30 years as a chief probation officer, retiring in 2000 to Martha's Vineyard with his wife. Officers said he cooperated during the arrest, leading them to the location of drugs on both his property and his person, according to a statement of facts provided to the court.
The suspect admitted that he had sold cocaine to an individual that members of the Task Force and Police Department observed exiting the property just before the arrest, according to a statement gathered by a NYC Criminal Lawyer.
He was ordered to pay $500 bail and forfeit his passport on Monday and is scheduled to appear in court again on April 22.

Mother in court for growing marijuana

The Police indicate to a NY Criminal Lawyer that a woman in East Wallingford is facing charges of felony because she grows marijuana in her home. The woman claims that she was cultivating the marijuana to use for her son who was severely ill.
The woman, according to what the Police told the New York Criminal Lawyer, would not have to stand any trial because of this one reason. The newspaper media reported that the prosecutor of the state made a referral that the accused enter into a Court Diversion program. If she completes that program successfully, the accused will be free of the charges.
The Police reported to the New York Criminal Lawyer that the woman has been persuading the legal system that she does not deserve of any felony charges since her son is so ill and the marijuana is helping him. She confesses that according to the legal system, she is guilty, but for her son, she would do whatever it takes to help him to be well. She did all of this to save her son’s life as he patiently waited to get a kidney transplant. Every day, her son had to undergo dialysis. In The Bronx and Manhattan growing pot is illegal.
The prosecutors of the state did not agree with her, though, because it was not legal to grow the medical marijuana. This only occurred in the state of California. Had she grown the marijuana in small quantities and inside of her home, it would not be deemed illegal. The mother was glad to compromise instead to enter a diversion program.

Posada’s Citizenship Application Raises Red Flags

A U.S. immigration official stated that the 82-year-old CIA-trained explosives expert exile Luis Posada Carriles application for US citizenship has raised concerns, and numerous red-flags. As she reviewed the form, she came across many things that were disturbing to her. Drug Possession was also suspected but never proven.

In section N400, Posado stated that he had advocated the overthrow of a government. He also noted a Panamanian conviction that caused him to serve 4 years in prison. There were others that were not available at the time of this publication.

In 2002 Posada was arrested for planning to assassinate Fidel Castro. He was convicted of a lesser charge. In 2004 he received a controversial presidential pardon, states a Brooklyn Criminal Lawyer. It’s not the first time that he came up against the law in Cuba. Cuban officials have alleged that Posada was involved in a little-known 1998 plot to bomb an civilian aircraft going from Cuba to Central America. He was also accused of a 1976 combing of a Cuban airline that killed 73 people. He was acquitted in a trial in Venezuela. Authorities in Manhattan and Staten Island have taken notice of this case for future reference.

Other people have testified that Posada also lied under oath at the hearings for asylum and naturalization in 2005 and 2006. Due to a litany of errors in translation and factual date in the transcripts of the hearings, the question of whether Posada lied under oath is still debatable. There are already plans in place to challenge the transcriptions and translations at an upcoming date, according to a New York Criminal Lawyer.

Posada applied for citizenship in 2005 after sneaking back into the country. He applied because of his service in the U.S. army during the 1961 Bay of Pigs. There are currently 11 charges against Posada.

Three Local Men are Detained In Steroids Case in Philadelphia

Three local men are suspected of distributing illegal steroids in the Delaware Valley region of Philadelphia.

Fourteen people were arrested related to the case, with two middle aged men being local to the region. All were detained Wednesday afternoon awaiting the results of the trial.

The steroids ring was managed by a police detective from Philadelphia. This was an extremely sophisticated and organized criminal venture. Large quantities of Anabolic Steroids and Human Growth Hormone were purchased from China and Europe. The New York Criminal Lawyer said that the most common drugs sold through the ring were Nandrodex 300 and Testodex Enanthate 250. Both of these are steroids which can be used to build muscles very quickly, however they have some very dangerous long term side effects. In Manhattan and Staten Island this is considered to be drug possession.

The scale of the steroids ring is thought to of been worth millions of dollars a year. The FBI have had a major success by shutting down this drug ring. Taking such a large quantity of illegal drugs off the market has helped to protect the public.

The two local suspects purchased the steroids from the police detective who then sold them onto clients in the local area. Many of the steroids were sold through fitness clubs for the purpose of body building, the N York Criminal Lawyer explained that the names of the fitness clubs were not released.

Federal agents also discovered that text messages were used to arrange the sales of steroids. The drugs were also sold through various websites such as www.steroids.com and www.isteroids.com. The New York Criminal Lawyer explains that this drug dealing ring could become much bigger if the websites were better designed, shutting down the drug ring this quickly was in everyone’s best interests.

The NY Criminal Lawyer said that the trial was ongoing. If the suspects are found guilty then they are expected to spend up to 10 years in prison. This was a very high profile case which was investigated by the Philadelphia PD, FBI, Drug Enforcement Administration and US Postal Inspection Service. The fact that this drug ring was run by members of the police force is very concerning, especially as it managed to run undetected for so long.

Three men are arrested on various drug possession charges in Long Island, NY. It seems they will need a Nassau County Criminal Lawyer.

A pharmacist was waiting in the parking lot of a gas station in Plainview when detectives overheard him having a conversation on his cell phone. The conversation was about a drug sale he was about to make. The detectives watched as 53 year old Syosset resident Robert Ciskanik sold narcotics out of his car. They then arrested Ciskanik and Hosam Karin, a 57 year old Freeport resident. Ciskanik was found to have over 400 oxycodone pills on his person. Karin had 15 Cialis pills on his person. While police were arresting the two men, another car pulled into the Old Country Road gas station. The passenger of the car walked over to Ciskanik’s car looking for him. The man, Michael Lulo of Nesconset, was found to have more than $17,000.00 cash on him as well as oxycodone and methadone. He was also put under arrest. Reports state that Ciskanik was licensed in New York State as a pharmacist but do not release where he was employed. According to a NY Criminal Lawyer, Ciskanik was charged with criminal possession of a controlled substance, criminal possession of a narcotic and criminal sale of a controlled substance. He was held on $100,000.00 bail. Lulo was charged with criminal possession of a narcotic and conspiracy. He was released on $6,000.00 bail. Karin was given a desk appearance ticket (DAT). All three men will be arraigned at Nassau County First District Court; located at 99 Main Street, Hempstead NY 11550. Drug Possession is treated very seriously in New York City and Westchester County.

Another Home Invasion Arrest

There has been one more arrest in the case of an attempted home invasion that ended with the death of one would-be burglar and the wounding of another, police sources told NY Criminal Lawyers.
Suffolk police investigators found a fourth man involved in the attempted home invasion – a 25-year-old man from Mattituck, who was subsequently arrested. He was charged with first-degree burglary.
NY Criminal Lawyers do not yet know how the police found the latest suspect or how he specifically participated in the attempted burglary. According to police sources, they believed only three men to have been involved in the April 13 incident.
One of the burglars shot a pit bull in the house with a .22-caliber rifle. Then, a resident shot the burglar, killing him. The resident had a permit for the shotgun and no charges have been filed against him. The dog is expected to recover.
The resident also shot another burglar, a 25-year-old man from Mastic. The wounded burglar was taken to Southside Hospital and listed in critical condition. Further details on his condition are unavailable.
The third burglar, a 27-year-old man from Aquebogue, escaped the scene but was soon caught, police sources explained to NY Criminal Lawyers. He was charged with first-degree burglary, and held on $1 million bail after his arraignment. A deputy bureau chief requested that amount due to the third burglar’s previous activities.
Records showed that the third burglar had already been arrested on drug charges, possession of stolen property and criminal mischief. Two of the charges earned him probation and time served. It is not certain what happened with the third charge. In Brooklyn and Queens, Drug Possession would be one of the more serious charges.
The burglar who died in the attempt had already served time in New York and New Jersey and had been arrested for other burglaries in Suffolk County in 2003. He was released in December 2007, police sources indicated to NY Criminal Lawyers, only to be arrested again in 2008 for failing to report to his parole officer. He had been released early, so was force to serve the final two months of his sentence.

More Crimes from the Blotter

A pair of Brooklyn bandits held up a pizzeria in Williamsburg.
The perpetrators, wearing masks and armed with guns, entered a Papa John’s on Grand Street near Leonard Street at 10 p.m. One of the robbers drew a silver pistol and forced the 18-year-old working the counter to open the register, cops told New York Criminal Lawyers.
The thieves took an undisclosed amount of cash, then ordered the worker to give them what he had, taking his cash and his iPhone, police added.
There are several stories out of Staten Island New York Criminal Lawyers are currently investigating.
The first is of a suspected drug dealer murdered in his car as he drove through Port Richmond. The 26-year-old victim was driving a 2003 Infiniti coup when he was shot through the open window of his car below the left eye at 2:39 a.m. on Harrison Avenue near Castleton Avenue.
The victim had been in trouble with the law before for drug-related issues and was caught in a 2008 prosecution sting. He was pronounced dead at the scene. Drug Possession in Brooklyn and Queens is treated very seriously by law enforcement.
In West Brighton, an ex-con shot up a rival’s car in a drive-by.
The 20-year-old ex-con shot at his enemy’s PT Cruiser as it was parked on Delafield Avenue near Broadway at 8:15 in the evening. The flurry of bullets broke four windows and put a hole in the body of the car.
The shooter was found in his home two hours later, armed with a semi-automatic weapon and listening to an NYPD radio that had been previously reported stolen. He was already on parole after a year in prison for shooting a man in the leg in 2008 at a movie theater.
Finally, a man in Midland Beach was arrested, thanks to a weapon found in his car.
Officers pulled the 36-year-old man for his illegally-tinted windows, when they found the Glock with 34 ammo cartridges in the car. He told the police he was going fishing, but he may actually end up in jail instead, police told New York Criminal Lawyers.

Chief Deputy District Attorney Arrested on Drug Charges

According to a New York Criminal Lawyer, a Chief Deputy District Attorney was arrested and accused of possession of rock cocaine in Las Vegas. Drug Possession in New York City or Long Island are serious crimes with huge penalties for the offender.

The 10-year veteran was working on a task force and handled celebrity drug scandals including busts of Paris Hilton and Bruno Mars. He could not be reached for comment regarding this matter. This would also be a very serious matter in Brooklyn, NY.

A District Attorney in the area revealed that in going over the defendant’s cases, he was relieved that there had been no wrongful prosecutions, explaining that everything checked out in the system and there should be no concern that the Deputy Chief had access to the drugs that were supposed to be evidence.
A Las Vegas Officer stopped the District Attorney’s white BMW a little before 5pm on Saturday near Desert Inn Road, an area where drugs are rampant. As officers got near the car, a passenger, 43, jumped out of the passenger side and ran. He later told officers that he knew the defendant only as "Joe," a regular customer who would call his cell phone to set up small drug buys. The passenger has had trouble with the law in the past, but there is no indication he was in a case involved with the defendant.

The Chief Deputy was supposedly a regular customer buying the drugs two to three times a week for at least the past six months. It is unclear at this time whether his actions hindered any investigations. Although his 10-year marriage ended in divorce in 2005, the defendant has had no trouble with the law other than this recent arrest. Two Stories of Crime in New York

A drug pusher may have been one of the few Americans to actually benefit from the events of September 11, 2001, New York Criminal Lawyers have learned. But now, his luck has run out.
The drug dealer may have already been in prison but for the fact that the evidence gathered against him happened to be in the World Trade Center on 9/11. Now another charge has surfaced and he will serve a five-year sentence for bail jumping – something he did more than 16 years ago, in an appeals court ruling.
Back in 1994, the deal was already on probation when he was arrested for allegedly being one of the men behind a crack ring in the Bronx. He was allowed to go on $200,000 bail, then went into hiding. In order to stay hidden, he even burned off his own fingerprints, sources have stated.
He was caught for drug dealing in 2007 and was sentenced to 151 months in prison. It was at that time he pleaded guilty to bail jumping in order to get a deal that would limit his stay in prison to no more than two years.
The judge wasn’t going for that, however. He claimed the bail jumper had made a “mockery of the constitutional right to bail” and made sure he got more than twice the two years – five years in total.
An appeal was made, but the Second Circuit Court of Appeals in Manhattan upheld the decision.
In other news, a fight between a former student and a school aide near a middle school in Queens resulted in hospitalization for one person and a sprained ankle for a dean who attempted to break up the fight, sources have revealed to New York Criminal Lawyers.
The argument between the two women started inside the school and moved outside, where their confrontation turned violent. During the fistfight on the playground, the dean attempted to intervene, but fell down as the others continued to fight.
Both of the fighters were arrested and charges are still pending.
One of the combatants was taken to the hospital, bleeding from the head. Authorities told N York Criminal Lawyers that none of the wounds were serious.

Suffolk County Executive Steve Levy has unveiled a new plan to stop heroin usage in Nassau County and Suffolk County’s younger generation. Suffolk County had over 1,000 heroin related drug charges this year and 50 heroin related overdoses. The dramatic statistics have made officials take notice. Suffolk is now forming a new heroin task force. They will be taking 31 officers from Suffolk County’s other precincts to form this squad. These officers will investigate all leads and tips that they receive. They have set up a text messaging hotline for tips to be called in anonymously. They will also going into the high schools and middle schools with social workers to talk to children about heroin. A Suffolk County Criminal Lawyer reports that officials are also trying to lobby for a new law to try to dissuade potential drug sales. They would like any vehicle used in a heroin sale to become property of the County.
The County is planning on offering free drug testing kits for parents and making guidebooks available to parents. These books will alert parents to the signs of heroin use and treatment options. They will be hosting “sober” events for recovering addicts. These events will be part of new support groups that will be formed for addicts who are looking for counseling.

The Mob, The Mulberry Bush, and The Marijuana Bust Reported by a Nassau County Criminal Lawyer

The bust labeled “Here We Go Round the Mulberry Bush” definitely has the characteristics of a big time organization. Marijuana and $1.1 million in cash was found and it is thought to be the profits from a money-laundering ring and even has ties to a mob. The apartment on Mulberry Street is located near part of the Bonanno crime family’s turf.

Two men were arrested last month in conjunction with this drug ring. A photo of one of these men in a field of marijuana was found in the flat and by all indications, the drugs were headed to California to fund a Mexican cocaine purchase and the rest would be shipped to Canada.

Two other suspects of the drug ring are Dehran Duckworth, a drummer in the band Narhed and a real estate agent. These criminals were caught last month with a duffel bag holding five pounds of marijuana. The bag was in a BMW, which was belonged to one of the suspects. The pot was found shrink-wrapped to help hide the odor of the pot and the other chemicals used in processing. Marijuana and Canadian Bud is a source of big bucks for the criminals involved in the drug industry.

The autopsy was inconclusive and the child’s father who was distraught said the woman was a good mother and he couldn’t imagine why she would do such a thing. The father was also decidedly upset that his son was left unidentified when obviously relatives much closer to the family could have made the identification. Mother Over-Doses 8-Year-Old With Ground-Up Prescription Medication States a Suffolk County Criminal Lawyer

A deranged woman, a distraught father and ex-husband and an extremely confused grandmother all try to make out the details behind the supposed murder of an eight-year-old boy. A Long Island couple sells Heroin to an undercover police officer and is put under arrest reports a Nassau County Criminal Lawyer.

Detective Loses His Job and Could Use a New York Criminal Lawyer

World of Warcraft game helps to catch a fugitive according to a Nassau County Criminal Lawyer

Police have been using online gaming to help catch thieves. A fugitive had been arrested for the sale of a controlled substance and the sale of marijuana in Illinois. He had managed to flee the country to avoid going to jail. Nassau County drug busts ends in 2 arrests plus child endangerment charges for one reports a NY Criminal Defense Lawyer

Nassau County Police had special operation officers patrolling in unmarked cars when an officer witnessed an alleged drug sale. Actor Michael Douglas’ son arrested on drug charges in New York City hotel reports a New York Criminal Lawyer

Cameron Douglas, the 30 year old son of famed actor Michael Douglas, was arrested in NYC for drug possession and drug dealing. A Roosevelt, New York man is arrested for robbery reports a New York Criminal Lawyer

Paul Kamienski could use a NY Criminal Lawyer

At age 35, Paul Kamienski was running three businesses, had cars, homes,
boats, and many parties. Then, in 1983, his lavish lifestyle ended when he was
convicted of being an accomplice to two drug-related killings.
Sentenced to two consecutive life sentences plus 12 years, Mr. Kamienski
struggled for 22 years behind bars, maintaining he was innocent. Last month, a
federal appeals court finally overturned his conviction. On Tuesday, June 16th,
2009, he was driven out of South Woods State Prison in Bridgeton, New Jersey,
after spending 22 years behind bars. The decision, written by Judge Theodore A.
McKee, criticized the New Jersey appellate courts for lacking substantial
evidence. However, the the ruling is under appeal by the Ocean County prosecutor
who says that the 12 jurors who first saw the evidence to a guilty verdict.
Then, in 1988, a jury in New Jersey Superior Court did in fact convict two
drug dealers, Anthony Alongi and Joseph Marzeno, of fatally shooting Henry and
Barbara DeTournay. Mr. Kamienski had introduced them to each other. He was found
not guilty of conspiracy to commit murder and robbery but was convicted of

EX-CON KILLS WANTAGH TEEN IN DRUNKEN GUN PLAY REPORTS NEW YORK CRIMINAL ATTORNEY

Saturday afternoon, 17 year-old Phillip Levy left his Wantagh, L.I. home to go joy riding with a few friends, but never returned. Levy was shot and killed in a Brooklyn apartment by a drunken ex-con showing off his handgun.

The teens were drinking while driving around Brooklyn, when they decided to visit 33-year-old Scott Bruno in his Bensonhurst apartment. Police believe that Bruno had been drinking all day and started playing around with his gun. Rapper Juvenile charged with possession of drugs-drug possession charges call for a NY Criminal Attorney
