Kentucky governor passes a divisive medical bill into law

The Governor of Kentucky has recently signed into law a controversial bill involving eye care for residents of that state.

The bill, labeled SB 110, has had a significantly short journey, from its initial overwhelming passage in the Senate to its impressive passage in the House of Representatives in Kentucky. A New York Criminal Lawyer realized that both of these passages occurred within the same week in January, followed by a brief pause in the process until the governor signed the bill into law on Feb. 24.

The main provision of the bill is controversial in nature: on the surface, it allows for optometrists to perform certain types of minor surgery on patients that was once only administered by highly trained surgeons. The governor is quoted as saying, “Access to quality health care is a critical issue for families across the commonwealth”. He went on to promote the decision, declaring, “After careful consideration, along with meeting with many interested parties, today I signed Senate Bill 110 to give Kentuckians greater access to necessary eye care”, according to a New York Criminal Lawyer. Opponents of this decision cite what they believe to be a disastrous result of this law: according to the president of the Kentucky Academy of Eye Physicians and Surgeons, “Optometrists simply do not have the training necessary to perform these procedures or manage the kinds of serious complications that can arise during surgery.”

On the other side of the debate are those who support the passing of the bill on the part of the Senate, House and Governor. One is an optometrist who will likely benefit from the law and who defends the ability of optometrists to perform these procedures: “That’s in the bill that they will establish the standards,” he claims. “That’s an important point; we will be held to the same standards as anyone else who is doing these procedures.”

A New York Criminal Lawyer understands that these procedures include clearing surgically-implanted lenses and removing benign skin tags from eyelids. While the provision of proper training is cited as support for this bill, many within the professional field remain uneasy of this change in law and its perceived dangers to patients.

With the passage of this controversial bill into law, a N York Criminal Attorney recognizes that there may be those who take legal action in response to either personal injury while under surgery, or other unforeseen instances of personal right claims.

Man charged with aggravated battery after domestic fight with girlfriend

A man who ignored his pregnant girlfriends request to turn off the television wishes now that he had paid more attention, according to a New York Criminal Lawyer. In her quest to be heard, the girlfriend apparently unplugged the television set in hope that her man would listen to what she was saying. That action caused an argument that led to much more than the man bargained for.

Police were called to the apartment where the argument was occurring, said the NYC Criminal Lawyer, but when no one came to the door, they called local firemen to bring a ladder so that they could get up to the open second floor window where the argument was taking place.
At that point, the owner of the apartment complex called the man, who then came to the door and finally confronted the police.

It was noted that police observed fresh scratches on the pregnant girlfriend’s face, which they questioned. The woman revealed that after she had unplugged the television set, her boyfriend got angry and pushed her in the face. The man was then arrested and charged with aggravated battery.

Reports by the NY City Criminal Attorney said that had the woman not been pregnant, the charges would have not been so severe, but since she was with child, the unborn baby was put at risk, upping the charges substantially. Because of her pregnancy, he has been charged with a felony. His trial is pending and more information will be made public once the dates have been set.

Accused Murderer Wants Video Evidence Dismissed

Even a person who has done incalculable deeds has rights in this country and those rights deserve protection, stated a New York Criminal Lawyer. It is the basis for our judicial system that each of us are innocent until proven guilty and that information regarding our guilt or innocence must be obtained in a way that is legal and fair.

A woman who has been charged with the death of her two year old toddler in 2008 is fighting to keep a video that was recorded against her knowledge out of court. The New York Criminal Lawyer reports that the methods used to record the woman's reactions to the fact that the remains of her daughter had been found were not legal or fair, and that as a result the information obtained in the video should not be allowed to be used against her.

Apparently, authorities set up what amounts to a video sting, said the New York Criminal Attorney, and this type of tactic has no place in a court of law. Whether or not the woman is found guilty of the terrible crime that she was charged with, the fact remains that authorities may not trick or manipulate a person and then record them without prior knowledge or consent in order to get information to use against them.

According to the New York Criminal Lawyer, the basis of a fair trial is just that, fairness and respecting the legal rights of all of the individuals involved, even if those individuals may have taken the rights of another person away.

Attempted Illegal Entry into US Foiled by Drug Sniffing Dog

If it weren’t for the fact that smuggling humans is highly illegal, this case may have had a touch of humor attached to it, explained the New York Criminal Lawyer.
A Mexican national was found trying to get across the border by hiding amongst paint buckets and other painting supplies, stowed in the back of a pickup truck. It was rather a novel situation in that the paint buckets had holes cut out of them so the individual’s arms and legs, chest and even body could fit inside the truck and appear to be a flatbed with cans, rags, towels, gloves and brushes tossed on top of the cans.
As far as being an innovative idea, it ranked right up there with the best of them. However, a drug sniffing dog took exception to the strange man in the back of the truck explained the New York Criminal Lawyer. Border patrol agents arrested him. The man will now also be used as a witness against the driver before he gets deported back to Mexico. The driver will face smuggling charges.
Cases like this are always difficult, as one can understand why an illegal immigrant would try to cross the border into the US, especially in these tough economic times. Unfortunately though, until the Comprehensive Immigration Reform Act either moves forward or dies, there are rules and regulations immigrants need to abide by commented the New York Criminal Lawyer. The consequence of trying to cross the border illegally is deportation and those caught face some major consequences legally.
If you have been in this kind of a situation, or are in this bind right now, it would be best for you to contact a New York Criminal Attorney and find out what your rights are. A New York Criminal Attorney will work with the immigration system to ensure you are treated properly and that you also understand the ramifications of any criminal charges laid and how they impact on your chances at immigration.

Ex-Yankee takes no responsibility to this day for drinking and driving, report New York Criminal Lawyers.

Jim Leyritz still blames his victim for his own drinking and driving incident and hasn’t learned a thing, said New York Criminal Lawyers.

"My life was dragged though the mud because I was a Yankee. I got tried because I'm an athlete! There was a good chance I was innocent!" Said ex-New York Yankee Jim Leyritz, 46, who drove drunk, killed a woman and never went to jail.

Leyritz, who was extremely angry at the police who arrested him threatened, "I'm gonna make them lose their jobs." He went on to slander his victim -- a waitress and mother who was killed on her way home in Florida at 3 a.m.
"I knew the girl," he revealed to New York Criminal Lawyers. "She was a dancer at one of the nightclubs."

When asked if the girl was a stripper, he said laughing, "I don't like to use the word," "She's a party girl."

New York Criminal Lawyers alleged that Leyritz ran a red light after consuming 11 to 12 shots of alcohol. Nobody could prove the light was red, and Leyritz refused a Breathalyzer test at the scene of the crash but tested a .14 three hours later, which is way over the .08 legal driving limit.

Leyritz was ultimately convicted by a jury of misdemeanor driving under the influence, reduced from the original charge of manslaughter, according to New York Criminal Lawyers. His sentence was probation.

"It was an accident. A onetime accident," he has said. "It could happen to you! You could lose three years of your life. I'm a good person!"

Being accused of any crime is a difficult process and New York Criminal Attorneys are here to help. Your case needs sufficient time and attention to detail and nobody is more qualified than New York Criminal Attorneys.

Simpson Petitions Court for New Hearing

He beat a murder rap once but earlier this year famed football player and former movie star OJ Simpson was finally convicted of something. After a break in at a Las Vegas hotel, Simpson was found to be involved in a criminal enterprise, one that robbed men of their possessions, said a New York Criminal Lawyer. Simpson claimed that the objects belonged to him - that he was simply reclaiming lost property. The incident happened back in two thousand and seven. Now, Simpson and his attorneys are seeking a new trial. But, in order to get a new trial they must first file for a rehearing and such a filing typically must happen within a certain number of days, noted a New York Criminal Lawyer. However, Simpson's lawyers have asked for and been granted an extension by their judge. This extension will give them additional time to formulate a reason and a plan of attack whereas it concerns getting a new trial, said a New York Criminal Lawyer. That said, such grants are generally not given: once a trial is done, unless there was a gross miscarriage of justice or the judge feels due process was not adequately adhered to, the trial is over and the guilty go to jail.

Simpson was a star football player for years. He was a star in college and in the NFL for decades. After that, he made the transition to the silver screen where he was a star in the popular Naked Gun film franchise. In the early 90s he beat a murder rap after being tried for the death of his ex-wife and her lover.

Just because a trial is over does not mean that all hope is lost for the guilty. A skilled New York Criminal Attorney can help protect your rights even after conviction.

Family Attempts to Sell Child On Black Market and Gets Caught

There are people in the world that do horrible things every day. Some do them because they were abused as children. Some do them because they are true sociopaths who just don't know any better. As a society we try to understand aberrant behavior. Understanding leads to transformation and a better world. But then there are some who commit acts that we just don't understand. A grandmother, a mother, a father, and an innocent child are at the center of a sad, sad case. The plan: sell the baby on the black market. Get as much money as possible, don't care who "owns" the child, just get the money and run, said a New York Criminal Lawyer. It was and truly is modern day slavery. Maybe even more disturbing was the fact that the parents, the mother and father the world entrusted with the safety of the child, liked the idea so much they planned to have more children for the sole reason of selling them. They wanted to be a manufacturing plant.

But, not all horrible stories have horrible endings. In a twist of fate, the grandmother turned to her other daughter to "adopt" the child, noted a New York Criminal Lawyer. The grandmother had given the daughter up for adoption (ironically enough) 20 plus years ago. They had reconnected and the grandmother mentioned giving the child up for adoption, said a New York Criminal Lawyer. The daughter was excited until the floor dropped out: the grandmother wanted seventy five thousand dollars for the child. That's when she contact the authorities who set up a sting and caught the terrible trio in the act, reports a New York Criminal Lawyer. The child is now safe.

Even those who have committed terrible crimes have rights that deserve protection. If you've been accused of a crime contact a New York Criminal Attorney today

Former Baseball Player Charged with DUI Homicide

A night out with friends, a few drinks, and a drive home. It happens every day, all across the nation. And while it often times can result in no harm and no foul sometimes disastrous events result. And disaster is the best way to describe what happened to the family of the young, thirty year old mother of two. While driving under the influence of alcohol is often seen through the eyes of the driver, with the focus being on his license being lost and the social stigma, in this case it was the beautiful mother of two that lost her life, says a New York Criminal Lawyer. Former Union Boss Claims Mob Coercion

A former union boss claimed the formerly-influential head of the city’s largest contractor’s association as a major crime family’s contact for corrupt construction unions, sources told a New York Criminal Lawyer.
The ex-union boss claimed the contractor was a messenger for a powerful mob capo who carried orders to the unions in the late 1990s. The contractor is currently on trial in Manhattan Federal Court for allegedly lying about his ties to the crime family, sources told a New York criminal Lawyer.
The ex-boss confessed to bribe-taking in 2004 and says he was only following the contractor’s orders to give union cards to mob favorites. When he refused to raise a “totally corrupt” union official to a management position, he says he was warned by the contract, “If you don’t, you’re going to be in a world of hurt.”
Later, the ex-boss was taken to a meeting with the capo himself. “I was patted down. … He said, ‘Don’t take it personal, but I had problems in the past with wires.” The mob boss says the contractor was there the whole time. The former union boss eventually convinced the capo to change his mind. The union boss retired too months later. The capo died in prison in 2009, at the age of 73.
The contractor is the last big name in construction to come before the court in a case that involved a District Council of Carpenters chief and seven cohorts pleading guilty in a 29-count federal racketeering indictment.

Cop Says He Never Pulled Gun on Biker

An off-duty police officer has been accused of pulling his gun on a biker in a road-rage incident, a New York Criminal Lawyer reports. The cop, on the other hand, says he was merely taking out his ID – not a weapon.
The officer denies he ever drew his weapon in the heated Greenwich Village confrontation, sources told a New York Criminal Lawyer. Nonetheless, the 29-year-old cop from the 28th Precinct has been played on modified assignment, at least until the details of the incident are better known.
The biker, a 36-year-old salesman from the lower East Side, the cop aimed a gun at his face after the officer almost hit his bike on Bleecker Street. A police source who knew something about the incident told a New York Criminal Lawyer that the cop only identified himself as a police officer. Another source says the officer only pulled out his department ID card and never displayed his gun to the biker.

To avoid going to prison or paying a fine, sometimes the best possible representation is needed. Not just any lawyer will suffice. Court Date Set in Vince Neil DUI Case

A Las Vegas judge has set the court date for Vince Neil for the charges of misdemeanor drunken driving and speeding charges, sources told a New York Criminal Lawyer.
The Motley Crue singer’s attorneys appeared for him in court and now plea was entered, according to a New York Criminal Lawyer. The judge overseeing the case set the date of October 11 for a status check, a court clerk told a New York Criminal Lawyer.
The 49-year-old Neil allegedly had a blood-alcohol content of 0.08 percent, which is the Nevada legal limit for drivers. Evidence also alleges Neil was driving his Lamborghini sports car at 60 mph in a 45 mph zone, when he was pulled over on June 27 not far from the Vegas Strip.
Misdemeanors and other minor crimes still need a New York Criminal Lawyer to prevent a small case from becoming something much larger and out of control. Representation is just so important when the time comes to stand before a judge or even to talk to police. There are just too many legal traps to fall into or too many ways for an honest mistake or a misspoken word to turn what should have been a simple fine or even an overturned case into an issue that could take years and a great deal of money to resolve. All that could easily be avoided with the counsel of a New York Criminal Lawyer.
You certainly don’t want your case to become more than it needs to be. Let a New York Criminal Attorney take control of matters. When you need to be represented in court, let your representative be a New York Criminal Attorney.

Times Square Bomber Gets Life in Prison

The would-be bomber of Times Square, Faisal Shahzad, received a life sentence in prison for trying to detonate a car full of explosives, according to a New York Criminal Lawyer.
Shahzad’s comment to his sentencing was “Allahu Akbar” – Arabic for “God is great”. “Brace yourself because the war with the Muslims has only just begun,” he said to the judge right before sentencing. “The defeat of the US is imminent and will happen in the near future.”
Shahzad is a 31-year-old father of two and a naturalized American citizen who lived in Bridgeport, Connecticut, New York Criminal Lawyers have learned. He pleaded guilty in Manhattan federal court to 10 felonies, including international terrorism and attempting to use a weapon of mass destruction.
The judge asked Shahzad about the oath he took to become an American citizen. He responded: “I did swear, but I didn’t mean it.” “You appear to be someone who was capable of education and I do hope you will spend some of the time in prison thinking carefully about whether the Koran wants you to kill lots of people,” the judge said to Shahzad at one point. Shahzad claimed the Koran “gives us the right to defend. And that’s all I’m doing.”
“Had the bombing played out as Shahzad had so carefully planned, the lives of numerous residents and visitors of the city would have been lost and countless others would have been forever traumatized,” prosecutors told a New York Criminal Lawyer.
The magnitude of the crime doesn’t matter – anyone accused of a crime needs an advocate like a New York Criminal Attorney. It is your right to have someone speak for your side, and you can have no better representative than a Nassau County Criminal Lawyer.

Real Estate Star Sentenced for Theft

One of the fastest-rising stars in the world of New York real estate hit the bottom when he was sent to prison for stealing from his colleagues, friends, and relatives to live the wealthy lifestyle to which he had become accustomed, New York Criminal Lawyers have learned.
The 39-year-old real estate executive will have to serve at least two years and eight months, which could end up being as much as eight years. He was also ordered to pay $9.5 million in restitution. The executive made a name for himself during the boom years of commercial real estate, sources tell New York Criminal Lawyers.
He lived a life of luxury, including private jets and a cocaine habit, which led him to spend $35 million dollars in a buyout. This turned out to be money he did not have, his attorney told a New York Criminal Lawyer.
The executive swindled more than banks. His family and friends also suffered from his criminal activity. From these sources, he got more than $17 million in loans and investment capital. He forged documents to misrepresent the extent of his assets or to lie about deals he was undertaking. Once caught, he pleaded guilty to 18 counts of grand larceny and scheming to defraud investors.
No matter what the crime or what the circumstances, it is your right to be represented in a court of law if accused of criminal activity. Your representation should be a New York Criminal Attorney. No matter what you plead or how you see the case developing, a New York Criminal Lawyer can guide the case to a fair resolution.

Cop Not Guilty of Assault, But Guilty of Lying

A former copy was acquitted of assault after knocking a protester form his bike, according to a New York Criminal Lawyer, but he was convicted of lying about what did actually happen.
The verdict seems to rely upon a YouTube video of the incident that occurred in Times Square in 2008. The tape shows the rookie officer slamming into a biker, who had apparently been trying to avoid the cop.
The 24-year-old ex-cop claimed he arrested the biker, after the cyclist purposely ran into him, sources told a New York Criminal Lawyer. The ex-officer also claimed on the witness stand that his superiors ordered him to do something about the bikers during a protest.
Officially, the NYPD portrayed him as a rogue officer, according to a New York Criminal Lawyer, but the jury found him not guilty of harassment and assault. The ex-officer was acquitted of four of six accounts, but he still may get up to four years in prison once his sentence comes down. He may also get no jail time at all, if the judge decides such.
Since the ex-officer had quit the NYPD already and has been convicted of a felony, it is impossible for him to become a police officer again. He had no reaction to the verdict, nor did he offer any comment.
If you or a loved one has become the target of a criminal investigation, you need the best help you can possibly find -- and that means a New York Criminal Attorney. There is no one better than a New York Criminal Attorney to make sure you are not given a sentence you do not deserve.

Miranda rights may have been violated in terrorism case, says New York Criminal Lawyer

During the recent terrorist scare in New York, U.S Department of Justice agents interrogated the suspected terrorist before reading him his Miranda rights. According to a New York Criminal Lawyer, there is an exception to the rule regarding Miranda rights that says government agents may interrogate a suspect without reading him his rights if there is an issue dealing with public safety. Because of the possibility that people could have been hurt, the agents did not have to read the man his rights.

It appears that agents may have been trained to seek answers before reading Miranda rights because of a case last Christmas where some believe that the reading of rights delayed government officials from getting to answers that could have saved lives, at least according to a New York Criminal Lawyer.

Some Congressmen have used the issue to bring up the idea that terrorists should be treated as military prisoners, in which case they do not enjoy the same rights and freedoms as citizens.

A New York Criminal Lawyer has said that the ability of federal agents saves lives, as they need to be able to save lives, while at the same time following rules that will enable them to later prosecute the suspect. If someone is arrested and questioned with having their Miranda rights read to them, there is a possibility that their charges can be dropped and they be freed, even if the case against them is strong.

A New York Criminal Attorney is the represenatation needed for alleged criminals. An experienced New York Criminal Attorney will ensure that your rights have been protected and get you fair trial.

Parks Chief Who Pleads Guilty to Stealing from Meters

The former North Hempstead deputy commissioner of parks and recreation has pleaded guilty to petty larceny. He was charged with stealing $620 in quarters from parking meters stored at the Port Washington Parking District Office, according to a Nassau County Criminal Lawyer. After entering his plea, the then-deputy commissioner subsequently resigned from his post, effective several days later.
A spokeswoman for the Nassau district attorney’s office told a New York Criminal Lawyer that the 58-year-old ex-deputy commissioner, resident of Mineola, will have to pay back the $620 stolen from the parking meters as a part of his sentence. Further details regarding the sentencing are pending the release of further information from the district attorney’s office.
Though the quarters went miss from the district office in 2006, the deputy commisioner was not arrested for the theft of the quarters until 2009, three years later. The reason for the long period of time between the actual crime and his arrest for the theft of the money is unknown at this time.
A box of quarters collected from parking meters disappeared from the Port Washington Parking District office in August of 2006, before they could be deposited. A few days later, the deputy commissioner deposited $620 in rolled quarters into his personal bank account, converted the money, and immediately withdrew it, said a New York Criminal Lawyer, in 2009.
Neither the former deputy commisioner nor his attorney could be reached for comment and any further details are currently unavailable, at least for the time being. The office of the district attorney also refused to comment further on the case.

Judge Refuses Allow Senator to Withdraw Guilty Plea Reports a Nassau County Criminal Lawyer

Former State Senator Efrain Gonzalez Jr. originally entered a guilty plea on charges of fraud and conspiracy. Now a Manhattan judges refuses to allow him to withdraw that plea. Apparently Gonzalez now says he was coerced by his lawyers to make enter the guilty plea. The judge has deemed that to be “preposterous” reports a Nassau County Criminal Lawyer.

Mr. Gonzalez, now 61, could serve seven to nine years for using thousands of dollars in state money. He was accused of using the state money to pay personal expenses including an apartment in the Dominican Republic, jewelry, Yankees tickets and his daughter’s college tuition. On May 8, 2009, he pleaded guilty stating that he had discussed this with his lawyer, a long time friend. Nassau County Criminal Lawyers report that Mr. Gonzalez indicated that he understood what he was doing and that his plea was being entered of his own free will.

Now, almost a year later, Mr. Gonzalez has asked to change his plea stating that his attorney at the time coerced him. Mr. Gonzalez told the judge that he entered the plea under “tremendous pressure” from his lawyer and was told to just answer yes as the judge questioned him. Now, the judge refuses to allow Mr. Gonzalez to change his plea indicating that his request to withdraw his plea is exactly how defendants attempt to undermine the judicial process. New York Criminal Lawyers indicate that the original lawyer in this case calls Mr. Gonzalez’s story “a near-total fabrication”.

The bust labeled “Here We Go Round the Mulberry Bush” definitely has the characteristics of a big time organization. Marijuana and $1.1 million in cash was found and it is thought to be the profits from a money-laundering ring and even has ties to a mob. The apartment on Mulberry Street is located near part of the Bonanno crime family’s turf.

Two men were arrested last month in conjunction with this drug ring. A photo of one of these men in a field of marijuana was found in the flat and by all indications, the drugs were headed to California to fund a Mexican cocaine purchase and the rest would be shipped to Canada.

Two other suspects of the drug ring are Dehran Duckworth, a drummer in the band Narhed and a real estate agent. These criminals were caught last month with a duffel bag holding five pounds of marijuana. The bag was in a BMW, which was belonged to one of the suspects. The pot was found shrink-wrapped to help hide the odor of the pot and the other chemicals used in processing. Marijuana and Canadian Bud is a source of big bucks for the criminals involved in the drug industry.

Mentally Challenged Young Adults At Risk and the Case Might Require a Nassau County Criminal Lawyer

When children are the victims of a crime, the general public is usually quick to react. When older children who suffer from mental challenges are the victims, sometimes the information is unclear and difficult to understand. And, what makes this situation even more difficult to understand is these young adults were in the care of people who had been convicted of a crime previously.

One 22-year-old male patient in a psychiatric center claims a worker molested him. The worker had disclosed on his application that he was an ex-convict but didn’t say that he had been convicted of a sex crime. And from all available information, this particular hospital never bothered to investigate to see exactly what the man had been convicted of prior to applying for and obtaining employment in this hospital.

Since the district attorney’s office has made the decision that this is not a prosecutable case, the victims could look for a Nassau County Criminal Lawyer from The Law Office of Steven Bilkis and Associates. These young adults are already experiencing difficulties with the general every day situations of life, and they are also easy targets for criminals.

According to a spokesperson for the hospital, the potential employee was questioned about the situation regarding his conviction but did not reveal any information about a sexual crime and the hospital did not then investigate further. The potential employee became an employee even though he had been convicted of lewd assault and battery of an underage male. This criminal act seems irreprehensible and the hospital even goes so far as to say that they are not required to verify the information of a potential employee even if it reveals potential problems.
